HABITUAL CRIMINAL LAWFIGHT IS SEEN Michigan Is Aroused by Sen- tencing of Woman to Life {+ for Fourth Offense. By the Assoclated Press. LANSING, Mich, December 13.— Michigan's moot law, which com- mands life imprisonment for a person four times convicted -of felony, had fastened its fingers for the first time today upon a woman. A jury of 10 men and two women yes- terday onvicted Mrs. Etta Mae Miller of selling liquor, her fourth conviction on a felony charge. The verdict was returned in the courtroom of Judge Charles B. Collingwood, the same judge who heard the trial of Fred Palm, first person to be sentenced under the law. ‘The Palm case attracted wide attention ‘when the defense contended that Palm was “given life for having a pint of gin.” Husband Is Serving Term. Mrs. Miller, 48 wears old, is the moth- er of 10 children, four of whom are living. Of these, she testified, she was the sole support. Her husband already is serving a penitentiary sentence for prohibitmn law violation. An appeal which may bring to a test | # disputed point in the habitual crim- | inal clause of the criminal gode will bz | filed by State Senator Seymour Person, | attorney for Mrs. Miller, he announced. ! erson was undecided today whether | the appeal would be from the convic- tion itself or would contend that the | habitual criminal clause should not be Fetroactive. Mrs. Miller's three previous convic- tions were prior to enactment of the present code in 1927. If thut isct is | used as the basis of an appeal, it lieved a Supreme Court decision \ould pffect similar laws in other States. Controversy over the law mvolvcd had been heated for several weeks. Repeal May Be Sought. ‘Two prosecutors recently have refused %o issue warrants for dry law offenders because of the life-imprisonment clause. Harold H. Smedley, Muskegon County prosecuting attorney, declared “my con- science wouldn’t let me.” Several re- ports have been published that a move- ment to repeal the clause would be in- itiated when the State Legislature con- venes mext month. Gov. Fred Green has indicated he will oppose any weak- enlng of lhe criminal code. r took her conviction calm- ty, but protested over and over last night in her cell that “they ca.nt send m m can't do it.” asserted throughout the tl’ll! that lhe }esnmony of the arresting officers was MICHIGAN COLLEGE SOCIETY SUSPENDED| Statements Liquor Was Used at Initiation Ceremonies Are Investigated.
