LOS ANGELES, July 11.—Bargain- ing over the guardianship of Priscilla Moran, 9.year-old film star, was charged in testimony vesterday in the court battle being waged for the cus- tody of the child actress. Miss Ruby F. Smith, former gov- erness of the child, declared on the witness stand that Priscilla’s father, Leo A, Moran, now dead, told her he made the bargain when his small daughter's first picture “Hungry Arms,” was shown in Tulsa, Okla. Father Opposed Adoption. “Moran told me.” said the witness, “that Mrs. Ella Smith Schaber, the owner of a motion picture theater in Tulsa, was going to advance $35.000 for Priscilla’s next picture, and that she demanded that she be made guard- ian of Priscilla to protect her invest- ment.” Miss Smith testified Moran said he was going to give Mrs. Schaber the guardianship, but added that ‘“there was a lot of difference between a guardianship and an adoption.” He also said he didn’t want Mrs. Schaber to adopt Priscilla under any circum- stances.
