The Goodyear Tire and Rubber Co alleges the misappropriations of Sei berling, while he was president of the company, had created on December 6, 1920, a debt of $3.744,729.06 which he recognized and acknowledged. This was reduced to $3,469.729 transfer of certain real estate to the! Goodyear Co, To cover this indebted ness, Seiberling also as Goodyear Co. 75,000 sha. ron, Canton and Youngstown rail way capital stock, and 250 shares of East Akrin Land Co. stock. The contract, it is alleged, guaran- teed the Goodyear Co. against loss in the transaction in the event Seiber ling failed to exercise an option to repurchase the securities and the company elected to sell them Stocks Sold for §1,376,000. The stocks finally w sold in No. wember, 1926, for §1 00, and the compjany now asks judgment for the | difference between this amount and the total of the 1920 debt. This action is the second brought by the Goodyear | Co. against the former president with in the past two weeks.
