According to Attorney George P. Hoover for the company, the District wrongfully as sessed and levied the tax on the poles, wires and conduits of the company as real estate. The company protested, but when threatened with distraint, paid the tax under protest under its conten- tion that the assessment should have been made as personal property and not as real estate. The identical question is awaiting decision before Justice Stafford in an equity proceeding brought by the Potomac Electric Power Co. to enjoin the District Commissioners from col- lecting a tax on its poles, wires and conduits, which had been assessed as real estate.
