Arthur r, owner of property in the vicinity of W 1sin avenue and Woodley road, has filed suit against the District Commissioners, John W. Oehmann, inspector of buildings, and Purdette owner of property at the corner of the two thorough- fares. He axks a_mandatory injunc- tion against the District officials to compel them to execute the orders of the Zoning C n and to re. voke a pe vker to proceed with the apartment on s though the cted on a cor- ner lot. Carr says Stryker subdivided the property at the corner of Woodley road and Wisconsin avenue into lots 49 and 48, with the latter an inside lot on Woodley road. Work on t apartment authorized to be e on lot 48 proceeded until Carr not that the walls approachs within 5 feet of the line of the ! when there should be under the zon ing regulations 10 feet. As the owner of adjoining property, he claimed, his interest w iffected adversely by the alleged ation and he reported to the Zoning Commission, which, he says, admitted the violation, but 10t order a change. The law requires the Commissioners, he says, to carry out the orders of the Zoning Commission which he declares they have failed to do. CONDUIT ROAD MEASURE GIVEN 0. K. BY HOUSE Passes Bill Transferring Jurisdic- tion Over Highway From Federal to District Government. The House veste which provides for transfer of juris diction over the Conduit road in the | District of Columbia to the Distriet Commissloners. The 19-foot strip down the center of the road, which the bill proposes to reserve to the War Department, is believed to be all that will be needed for the maintenance, repair and pro- tection of the aqueduct tunnel, for which the War Department is re- sponsible. 1t was emphasized that the Conduit road is in fact a_public highway through & section where development is rapid. The road was built origin- ally for the purpose of maintaining and repairing the aqueduct and the cost of maintaining it has rged to water revenue of the trict_of Columbia.
