By the Associated Press. NEW YORK. February 15.—Gerald Chapman, convicted bandit and mur- derer, today lost his appeal to the United States Circuit Court of Appeals for a writ of habeas corpus. The ap- pellate court susiained the order of Federal Judge Thomas of Connecticut in dismissing Chapman’s application for the writ. The opinion handed down today, written by Federal Judge Manton, de- clined to go into the question of the validity of the President’s commuta- tion of Chapman’s sentence. The -ourt held tha: only the United States Government would have the right to enter an pbjection in this connection and pointed out that the Governmen:, through Assistant United States At- torney Cohen, had urged that the sen- ence of the Connecticut State court be carried out.
