DECISION UPHELD United States Circuit Court of Appeals Sustains Ruling That Sale Was Legal. By the Associated Press. PHILADELPHIA, Pa., March 27.— The United States Clrcuit Court of Appeals for tha third district yester- day sustained the Federal District Court of Delaware In dismissing the suit of the Government to recover from the Chemical Foundation, Inc., the seized German dye patents, copy- rights and trade marks sold to the foundation by the allen property cus- todian during the administration of President Wilson. The suit, instituted by direction of President Harding in the Fall of 1922, has been hard fought through the district and appellate courts and is expected to reach the Supreme Court of the Upited States. The then Attorney General, Harlan Stone, now on the Supreme Bench, made the closing argument for the Government when the appeal was heard here last November. Price and Sale Attacked. The patents and other rights, ap- proximating about 5000, were sold to the foundation for $250,000. The Gov- ernment not only contended that the price was inadequate, but that the sale was irregular and the result of conspiracy on the part of certain officers of the Government during the Wilson administration. The validity of certain acts of President Wilson, Frank L. Polk, counselor of the State Department, and other officers, was questioned, but the appellate tribunal affirmed the lower court in dismissing the complainant’s contentions. In summing up the conspiracy charge the Court of Appeals sald: “The Government has insistently pressed its charge of conspiracy throughout the proceedings in the trial court and here on appeal. We have, therefore, kept the subject constantly before us in our study of the case and in our deliberations. It will be enough to say that we have found no evidence that =sustains either the charge of conspiracy first made against representatives of the industry or the charge of conspiracy latgr made against officers and agents of the Government.” Sale Was Palmer Idea. The court found that the plan to seize and sell German patents was not instigated by representatives of the industry, but that the plan “had its birth in the mind” of A. Mitchell Palmer, then custodian, after he had decided that the patents be disposed of in such a_way as not to create a monopoly and to the best interests of the country. The court, however, pointed out that when Mr. Palmer made the con- tract of sale Mr. Garvan was an of- ficer of ‘the United States serving without compensation as a “dollar-a- year man.” “When, later, he became allen prop- erty custodian and also president of the Chemical Foundation,” the court said, “there was present the element of two official positions, and in these positions, it is true, he carried out the cortract previously made, but there was lacking the element of a direct or indirect interest on his part in the pecuniary profits or contracts of the foundation, for he agreed to serve as its president without compensation, and he has kept his agreement.” GROCER LEFT $104,643. John Keefe's Estate Goes to Fam- ily and Charity. John Keefe, a retired grocer, who died March 7, left an estate valued at $104,- §43, according to the petition of his widow, Mra. Mary Keefs, for probate of his will. Mr. Keefe owned real estate valued at $100,000, had Liberty bonds of $2,000 and $2,643 cash. His will directs that $300 each be given the Little Sisters of the Poor, St. Joseph's Orphan Asylum and St. Ann's Infant Asylum. To his daughter, Lillian K. Hannon, he leaves premises 2405, 2407, 2409, 2437, 2439, 2441 Eighth street and 2420 Geargia avenue. The re- maining estate is devised to the widow for life. At her death the house at 1516 Corcoran street is to go to a grand- daughter, Mary Hannon, and premises 537 Florida avenue to the daughter, Lil- lian K. Hannon. The rest of the estate goes to the son, Thomas J. Keefe. The widow is named as executrix, and is represented . by Attorneys Toomey & Toomey. WIFE ASKS DIVORCE. Charges Husband, a Carpenter, Won’t Work in Winter. Becauso her husband, Maurics N. Burrows, a_carpenter, had not heen in the habit of working during the Winter and refused to work last Winter, Mra Kate L. Burrows yesterday filed suit for a limited divorce and alimony agatnet him, She also asked the court to re- quire Burrows to stay in Washington pending the hearing of her complaint. They were married Jure 13, 1923, and Mrs. Burrows says her husband broke his record by working the first Winter after their marriage. When January came this year, she declares, he quit working, saying he had promised him- eelf and his mother that he would not agaln work in the Wintertime. Since January he has not supported her and the children. Mrs. Burrows explains that before marriage the parents of her husband had indulged him in his re- fusal to work after the snow began to fly.
