BALTIMORE, February 7.—The Court of Appeals this week handed down an opinion that parts of the zoning ordi- nance are unconstitutional, and as a consequence Baltimore today is with- out & zoning law. But there is no danger of a rush of Stores, garages and other business enter- prises to residential neighborhoods, ac- cording to city officiats. An old ordinance, paswed before the zoning law went into effect, will prevent that until a legal zoning law is passed. The court split in its decision, five judges deciding the ordinance s uncen- stitutional and two veting in its favor. The majority opinion was written by Judge Oftutt, with Judges Adkins, Digges, Parks and Walsch concurring. Judges Bond and Urner dissented. The opinion does not deal with sec- tions of the zoning law which regulate height and area of buildings But it says the regulation of the uses to which buildings may be put is met, by the terms of the measure, based on public welfare, utility, health or morals, and conflicts with the | Constitution of the United States in ¥hat it deprives an owner of the legal use of his property.
