By the Associated Press. EBENSBURG, P June 9.—A mo- tion for separate trials for forty-four Individuals, indicted upon charges of riot and murder, was expected to be | made before Judge Thomas B. Fin- letter of Philadelphia, specially pre- siding, when the Lilly riot cases are called for trial today in Cambria county court. The cases grew out of the riot April 5 at Lilly between vil- lagers and visiting Ku Klux Klans- men Two residents of Lilly were killed and a third died of injuries several days later. Klan Counsel’'s Program. Tercy Allen Rose, chief counsel for twenty-nine alleged klansmen, indi- cated that his first move would be to ask for separate trials and that he would be joined in the motion by Thillip N. Shettig of counsel for fif- teen residents of Lilly. District At- torney D. P. Weimer said he would oppose the motion and ask for a joint trial under the indictment charging all of the defendants with riot, affray and unlawful assembly All of the defendants, in addition, are under three indictments charging murder, the indictments naming Fran< Miasco, Phillip T. Conrad and Lioyd Paul as victims of the riot Another indictment charging carry- ing concealed weapons was returned against cach of the alleged klansmen. Alleged Cause of Riot. The riot occurred when a fire hose was turned upon the klansmen as they were boarding a special train at Lilly after having conducted a dem- onsiration on _a hillside overlooking the village. CHICAGO, June 9.—Nearly 15,000 Thysicians of the 90,000 members of the American Medical Association are expected to attend sessions of the convention, opening today., to con- tinue until Saturday. A wide range of topics will be discussed. The secret splitting of fees among physicians was condemned in a report of the judicial council.
