KLANSHEN APPEAL TOSUPREME COURT Seek Review of Lower Court’s Refusal to Ban Printing of Order’s Papers. Supreme Court review of another case Involving the Ku Klux Klan—its &uit to prevent publication in Hearst's International Magazine of papers al- leged to have been stolen from Klan nattonal headquarters, in Atlanta—is sought in an application for a writ filed today with.the court and opposed pany, publishers, Now on the court's docket is the case of former Gov Walton of Oklahoma appealing from his {mpeachment resulting from his fight with the Klan. In the papers flled with the court today the Knights of the Ku Klux Klan, Inc., are asking the court to re- view denial of an injunction, by the second federal circuit court of ap- peals to restrain the Hearst maga- zine from publishing the alleged stolen papers. The Klan brief de- clared that an important principle was at stake in that the lower court, while sustaining its property rights {n the papers being published, denled the injunction, although the publish- ers ““merely stated, without a scintilla of proof, that complainant ls engaged in a conspiracy against the United States.”” This presents an issue rave and far-reaching in effect,” the Klan brief, declaring: “It is admitted that complainant is lawfully organized; it is nowhere al- leged that complainant is or has been charged with any crime by the government or by any Individual through authorities constituted for that purpose.” magazine publishers denied that the alleged stolen papers had been proved to be the Klan's property.
