OVER PUSHEARTS Case Before Judge Schuldt to Determine Legality of the D. C. Regulations. Arguments in a case designed to ‘test the legality of police regula- tions against pushcart vendors be- gan yesterday afternoon before Judge Gus. A. Schuldt in the District of Columbia branch of the Police Court. The hearing was on a motion to Quash the information against James Jeurages, a pushcart vendor, charged With violating police regulations In making sales in restricted territory. Attorney James A. O'Shea represented the defendant and Assistant Corpora- tlon Counsel Frank W. Madigan rep- resented the government. _ Judge Schuldt took the matter under ad- visement for a future opinion, and in the meantime both attorneys will file memoranda quoting sauthorities. Other Defendants Interested. There are a large number of other defendants charged with the same offense. The right of the District of Columbia Commissioners to make @ police regulation creating a zone In the downtown section of the , in Which licensed street vendors shall be restricted, is the issue. The case Will be taken to the District of Co- lumbia Court of Appeals for final ad- Jjudication should Judge Schuldt de- cide that Commissioners are vested with such a right. stricted zone is bounded on the east h street, south by B street, on t by '17th street and on the north by K street northwest. The 1egulation provides that “no licensed street vendor shall be permitted to sell or offer for sale any article or thing in the congested section,” as provided in the bounds of the re- stricted zone. Attorney O'Shea contends, with other things, that the regulation is vague and indefinite, and lacks pre cion necessary to charge a cr’:ne. that the information is unconsti- tutional, since it deprives the sccused of the right of trial by Jury: that the regulation upon which the infor- mation is based “is unreasonable, un- constitutional and unduly restrains trade.” = SAYS HE -WONT PUT OFF SCREENS ANV LONGER - HE'LL GO UP AND GET THEM NOW SPENDS TWENTY MINUTES TRVYING TO GET EXTRA SCREEN ABOARD (C) Wheeler Syn.
