McNeeley, colored, said to be a real estate broker. McNeeley had been charged by Wallace E. Cost- ner with receiving a deposit of $125 on the sale of a house; which, it i alleged, he had no authority to sell. The facts in the case did not warrant an indictment the grand jurors held.
