Maury Dove Company takes {ssue with the city: heads on several phases of the wharf controversy as outlined in the com- munication sent by the Commission- ers to the National Rivers and Har- bors Congress-and published Friday in The Stan Commissioner Rudolph said today the fetter had been received and considered by the board of Commissioners, and had been referred, without comment, to the wharf committee, for later report and recommendation. Commissioner Ru- dolph declined to comment on the con- tents of the communication pending the wharf committee's report. Text of pany’s Letter. The letter of the company, signed by J. Maury Dove, jr., its vice presi- dent, follows: “Assuming that your letter to the national rivers and harbors congress, as printed in The Evening Star under date of September 30, was typo- graphically correct, we are at a loss to understand your reasons for evad- ing an issue so clearly and concisely determined. “Reference to correspondence be- tween ourselves discloses the fact that never have you heretofore even intimated to us that our wharf was unsafe. Your position has been that you would not permit the-storage of cord wood on the Washington chan- nel, taking the position that the same was unsightly and therefore a com- modity upon which the eye of the visitor to Potomac Park should not be permitted to rest. “We take direct issue with you with respect to the condition of this whart and deny that the same is unsafe for the purpose to which it is put. You must know that cord wood is not stored upon the wharf, but it is stored upon a fill immediately adjoining the same in the rear. been stopped by not stored thereon. We have had a prominent wharf builder examine! this wharf today and he confirms all that I have said above. It would therefore seem that there is some other underlying cause, not yet dis- closed by you, for your refusal to lease this property to us, for cer- tainly the safety of the wharf can- not be at issue, and even if it were it would be & simple matter to repair it. Alleged Eftect of Method. “We would further call vour atten- tion to the fact that you have stated that it is not your intention to inter- fere with water-borne commerce, but that it Is your intention to foster this commerce by permitting the use of these wharves for transshipment pur- poses. your express desire td0 foster com- merce and your method of fostering the same are inconsistent, and the ef- fect of applying your method would such commerce. Bulky such as cord wood, lum- nnot be handled over wharves in this manner. The whole process is economically unsound. The storage of such commodities must be at the point of discharge, and it is impractical to handle these in any other manner. I beg leave to remind you of the fact that you yourselves have recognized the wisdom of han- dling brick, sand. etc., in this manner, and we note that you are storing these commodities on your wharf at the foot of Sth street, and are not simply landing the same there and hauling them to some other point of storage. Henderson 1109 F Street ent. “We take this opportunity of re- iterating our previous statements to you that we are thoroughly in a cord with your policy of cleaning up the water front, but we cannot that the cleaning up of the front and the handling and storage of cord wood are inconsistent, and repeat that the present condition of the wharf rests solely at your doors and has been caused primarily by, your method of leasing these prop-: erties. We cannot imagine any! tenant who would take a piece of| property with the conditions under, which you lease these wharves and | spend any considerable amount of money | upon improvements of sald property when it is distinctly set out in your lease that the improvements shall be the absolute property of the Di trict of Columbia at the termination of said lease. Your policy has been to lease not in excess of five years and at the end of these five years the property is put up at public auction, which means that a man bidding $1 or even less possibly will be awarded the property, and the Improvements and the money which the former te: ant had made and expended would be entirely lost t ohim and he would re- celve no recompense whatsoever. Urges Change In Leasing Polley. “In our opinion this whole water- {front proposition can be worked out if your honorable board will change your policy of leasing so that the same will encourage the tenants on the water front to maintain and im- prove these properties in the same | manner as is done in New York and | in other large citles of which the writer has knowledge. Almost in-j variably these leases are made for| long periods, in the majority of cases for twenty years, and it is usually provided that the tenant at the ter- mination of the tenancy shail be re- imbursed by the city for any addi- tions to the property which he has made during the time thereof.
