SAYS COURTS USE TRADE LAWS TO CONTROL LABOR Gompers™ Tells Senate Committee Rights of Workingmen Are Being Impaired. Laws designed to control business “are likely to be comstrued by the courts to control labor, to tie men up to their jobs,” Samuel Gompers, presi- dent of the American Federation of Labor, declared today before a Senate committee, in continuing his discus- sion in opposition to the Calder coal regulation bill “That isn't right,” said the veteran labor leader. ‘“Labor is the lifeblood of human beings; business is some- thing else. “You can outlaw men, put them in jail, but you can’t stop them from ceasing work when their interests, their constitutional rights, are being impaired.” “Men of labor were delirious in their patriotism during the war,” he said, jSpeaking of the use of the'\Lever act to prevent strikes of miners. “The war transformed me from a decent sort of a pacifist to a pretty good fighting man, but the Lever act was turned against us in the courts after the Attorney General had declared it would not be coastrued to control la- bor disputes. “All these compulsory arbitration proposals—the latest freak thing is the Kansas industrial court —make employes and employers _litigants. They can't confer together to seek their own mutual advantage—they are made litigants.” MRS. HAMMERSTEIN LOSES $124,567 SUIT Two Stepdaughters Win Action Brought Against Third Wife f of Impresario. NEW YORK, February 10—Mrs. Oscar Hammerstein, third and last wife of the late impresario, has lost $124.567 from the estate of her hus- band by an award made by former ‘ Appellate Justice Francis M. They are the daughters of Mr. Hammersiein's second wife, who di- vorsed/nim. i\ he suit, of a highly complex na- ture, goes back to the date of the divorce, when the impresario agreed to pay $200 weekly to Mrs. Melvina Hammerstein during her life and $100 weekly to each of her daughters after {her death. The daughters sued for { the recovery of 3,998 shares of Ham- erstein Opera Company stock and & merstein Amusement Company; trans- ferred by Hammerstein to his widow, | which the daughters claimed was de- posited as security under the $100-a- week arrangement. He has the backing of a number of other senatora in the stand he has taken. If the naval bill. therefore, provides for the continuation of the building program as it relates to battleships, a fight of no small proportions may | be_ expected. It is a foregone conclusion that the naval bill will make such provision as it will be reported to the Senate, in view of the report on the Borah resolution submitted to the Senate vesterday by the naval affairs com- mittee.
