Their streets did not conform to the plan of streets of the proposed federal city, and the surveyor in charge of the street plan was directed by the Commissioners to run through these subdivisions. The Carrolisburg Sybdivision. The land which was subdivided Into Car- rolisburg was in 1770 the property of Charles Carroll. the father of Daniel Car- roll of Duddington. In that year the sub- division was made, and a record of the plot will be found in the land records of Marl- boro’, Md., the county seat at that time. A plat of the subdivision is now in the Li- brary of Congress, in the Peter Force col- lection, and the history of the acquisition of the above lot No. 102 and other lots in Carrolisburg and Hamburg, with maps of the extersion of the stre:ts of Washington through them, will be found in the office of the superintendent of public buildings and grounds, in the War Department. In connection with the subject of >xpense for improving the streets which it 1s pro- posed to extend under the highway act, it may be worthy of mention that some of the Streets through Carrollsburg, the land for which was acquired in 1791-2, hav> not yet been paved. The cost of acquiring land for streets for future use does not necessarily irvolve expense for improvements of such streats. An Erroneous Impression. The history of the early days of the city is referred to for the purpose of correcting the erroneous impression that many have that none of the land acquired for the streets of Washington was paid for by the government. erroneously now made That position has often been taken in opposing the claim 'y the District that the govern- ment should pay half the cost of lots taken for streets in the subdivisions in line of the present street extension plan. A recent development tn the highway sit- uation is the filing of a motion to dismiss one of the condemnation cases for want of Prosecuticn. The case was called up for argument last Monday, and the court was informed by the special attorney for the District that the Commissioners had given instructions to go no further with the pros- ecutlon of the cases until an effort is made to obtain an amendment of the highway act. One of the grounds of the motion to dismiss is that the Commissioners have loned the prosecution under the law in suen cases made and provided, and that the pendency of the proceedings on the records of the court is a damage to the property in question and a cloud upon the title. Unless Congress Acts. The fact that the prosecution under ex- isting law has been abandoned seems to be beyond dispute, and to keep the cases in court awaiting the uncertainty of Con- gressiona! legislation cannot be reasonably expected. Judge Cox intimated during the argument of the motion that unless Con- gress: makes some provision before the coming summer for carrying on these cases they ought to be disposed of. Such action by the court would have the effect of final- ly ending the proceedings, as the District could not begin a new proceeding to con- demn under the present law. If, therefore, Congress does not act during this session, the property owners will seek relief from the court by insisting upon the dismissal of the proceedings. C. H.
