This afternoon Judge Miller investigated the charges against Bailiff Kendig of “cap- ping” for Lawyer prell Carrington, as Published in The Star at the time. The charges were preferred by Lawyer Eugene J. B. O'Neill. In the judge's private room, where the investigation was held, sat those interested in and others, and there was no attempt to make the affair a star chamber proceed- a Verbal and written statements were re- ceived, and the affidavit of Campbell Car- Fington, jr., denounced the charge, so far as he was concerned, az a “malicious tie.” A number of attorneys came to the front for the accused, and said of him that be was an impartial and courteous officer of the court. Mr. Carrington made a xirong denial of the charge so far as it affecued him, and Lawyer Moss, whose name was mentioned in the proof. also made a denial Judge Miller in cxsncrating the bailiff | spoke of the duties of the oificers of the | court, and of the right of the prisoners to have counsel. So far as he was con: he did not propose to put any bar in the way of the employment of counsel by the unfortunates so long as the rules of the court were not transgressed. ‘THE COURTS.
