As a lvcal NEWS paper Advertining Medinm The law against soliciting political eontribu- tions in public buildings, as construed by the Supreme Court of the District, means consid- erably more than the public welfare absolutely requires. The evil to be remedied was the so- licitation of clerks for contributions for politi- cal purposes by such persons or in such places or under such circumstances that the request became a demand, backed by a tacit threat of dismissal, and an element of blackmail thus entered into the transaction to make it criminal, Evidently there is nothing immoral or hurtful in the mere act of asking a fellow citizen for a political contribution, whether he be employed by the government or not, provided the cir- eumstances of the request are such that there ia no taint of this species of blackmail about it. It is reasonable that the law should prohibit any employe of the government from solicit- ing any fellow employe and should prohibit | 5 the spproach of a clerk in any goverumen' building by asolicitor who, it might be «uppose would not have access to the clerk, if kis er- rand were not approver by the clerk's superior officers. In shor: every prohibition is reason- able which protects the clerk from oflicial pres- sure to contribute, and which tends to kill the notion that the public offices are held on con- dition of paying tribute from their proceeds to some political party. When the protection of these probibitions is given the clerk may weil be left on the same footing as any other man, not prevented from contributing if he pleases, linble to be asked to contribute, ut able to decline with impunity, if he is not disposed to comply. There are two things de- eided by the Supreme Court which are not absolutely necessary for the proper protection of the clerk. The first is that no person whatever, including those not employed by the government, may bo asked for a polit- ical contribution in a public building. This construction would prevent one private citizen from asking another to contrib- ute $5 toward meeting the expenses of holding the ciection of District delegates tothe next national convention, if the citizeus bap- pened to be at the time in the rotunda of the Capitol or in the corridor of any of the depart- ment buildings. Of course this prolibition has nothing to do with the objects of the reform Iegislation, but the government bas full con- trol over its buildings and may forbid the public to talk about political contribu- tions, politics or the weather within their walla, just os it might exclude from them, if it pleased, all persons wearing red neckties. The other point decided im effect is that the mailing of a soliciting circular toa person within a government building isa solici- tation within the building made criminal by law. Solicitation im the clerk's owa ofiice has the threatening Dbiack-mailing character ealy when the solicitor reaches him personally, coming supposably with the approval and connivance of his ciicial superiors. What reaches him by mail in his office comes clothed with no other at- tributes than those of the mail which is re- ceived by him at his residence. In both cases the personal golicitor is the mail carrier. If the government wished to prevent its clerks from receiving disturbing mail while engaged in public duties it might probibit mail delivery at the departments. but by this Jaw it Proposes to punish a private citizen for addressing to some one at a public build- ing that which he might innocently send to the latter's residence. It construes the mailing of a letter as presence in the place to which a let- ter is sent, even in copstruing a criminal statue, which would not ordinarily be sub- jected to any stretching. If one private citi- gen should mail a soliciting cireular to another private citizen and send it for convenience to the House post office, he would be liable to in- dictment and punishment. Muiling the letter would place him constructively within the Capitol, and political contributions may not be mentioned within its sanctified walls. We should be slow to imprison a man for mail- ing aletter, the act proposed by the letter being legal, the mailing itself being unobjec- tionable if the number of a house instead of goverument department were written on the envelope, the misdemesnor consisting solely in the manner in which the letter is addressed. It is possible to extend the application of a law, until public sentiment revolts against its en- forcement, and the practical purposes for which it was enacted fail to be accomplished in the general disregard of the law which follows. Taz Star docs not need to re-aiirm its hearty support of reform of the civil service and of the abolition of the spoils system in all its ramitications, including the blackmailing assessment of the government clerks. To assure the protection of the clerks against compulsory assessments considerable extension of the application of the law may well be justified, but the spoilsman could wish for nothing better than the unnecessary stretching of this good and effective law until it breaks. In its practicalapplication cases in- volving a violation of the spirit and letter of the statute, and suck alone, should Le promptly and vigorously prosecuted and punished. — There has long been a sentiment, not con- fined to Union veterans and not even to the partof the republic which, during the war, ad- hered to the Union cause, in favor ot removing to Arlington the resaains of all the great heroes of the war on the side of the Union. ‘The treat- ment of Gen. Grant's remains by New York bas Breatly strengthened this sentiment. The movement to carry out the popular wishes in this regard has not been weakened by delay. It will be renewed at the approaching session of Congress with strong prospects of its sac- cess.
