S. TAPPAN. 004: MISS EVELYN’S APPEAL. Her Counsel Claims That Mr. Hurlbert Has ‘Not Tried to Locate Murray. In the appeal of Gladys Evelyn, the actress, against William Henry Hurlbert, after Tue Stan's report closed yesterday, the attorney general, Sir Richard Webster, on behalf of Mr. Haribert, said that the most deliberate perjary had been proved against Miss Evelyn in regurd to the relations which existed between herself and both Mr. Hurlbert and Jackson. The judge who presided at the trial of the suit, con- tinued the attorney general, dwelt upon the point of her perjury, and the jury were unani- mous that no promise of marriage had ever been made. Sir Richard Webster also snid that if the “bogus” letters which had been produced had been genuine some of these letters were of 30 thastly and horrible a nature that they could rdly be associated with any man’s promise to ight. Hon. Edward Ebenezer Kay, one ot the lords justices of her majesty's court of appeals, here asked to see one of the letters re- ferred to in order to compare its handwriting with that of one which was acknowledged to have been written by Mr. Hurlbert. A letter from the lot was then handed up to the bench, and Sir Richard Webster, continuing, mid: “I asked that poor old man——" Lord Esher, master of the rolls, here inter- rupted the attorney general, asking sharply, “What old man?” . ‘Why,” replied Sir Richard, calmly, “Mr. Hurlbert is between sixty-five and seventy years of age. When he was asked if he had ever written a letter of euch a character to any woman he replied, ‘Never,’ and no one who knows Mr. Hurlbert would believe that he could write such filth.” At this stage of the proceedings Sir Richard Webster said that he proposed to read the letters which “that woman” had sent to Mrs. Hurlbert, but Miss Evelyn indignantly Re tested that she had never written to Mrs. Hurlbert in her life. During the course of Sir Richard Webster's argument the master of the rolis, Lord Esher, asked whether there was any evidence that the defense had tried to find the man, Wilfred Morray, who was alleged to be the real author of the letters. Referee Dunn's Decision in the Recent Fight—Hot Words With Savi Jore Dunn, the referee in the Slavin-Kilrain glove fight. rendered his formal decision last night. He awards the fight to Slavin, but declared that Kilrain was not knocked out. Bets that the contest would not last ten rounds are won, because the winner is declared after Jeas than than nine rounds had been contested. Dunn says that Timekeeper Kelly made an un- fortunate mistake after the electrical gong got out of order by not calling out from his watch by which he wag timing the seconds that elapsed when Kilrain was down in the ninth round. He adds that he considers himself equally at fault for not keeping his eyes toward the center of the ring at the time in order to see for himself how quickly Kilrain got up. | He explains the fact that his pack was toward Kil- rain by saying that he felt it hie duty, on ac- count of Slavin’s method of fighting, to watch the Australian to prevent him from fouling. Dunn states that Slavin always showed a desire to go in and slug kilrain the instant he arose froma knock down. The referee pnts himself on record as being against euch tactics and says he would have decided against Slavin had he committed that act in the ninth round. As Kilrain was practically beaten the referee did not like to be put ina position to decide against the foreigner on the ground of a foul, so he de- voted his energy toward keeping Slavin m his corner rather than standing off and watching both men. "Slavin was re- quested to leave the hotel and he did. eee BARDSLEY'S DEFENSE, He Denies That He Used a Dollar of Phila- delphia’s Money for His Own Profit. Ex-City Treasurer Bardsley of Philadelphia is said to be preparing a defense, which he will present to the court on next Tuesday, when he comes npfor sentence. In the first place, it is stated that he will stoutly deny any intentional dishonesty. He will admit, as he has admitted in court, that he violated the letter of the law in two particulars—first by loaning the public fands for profit and second by depositing in the Keystone Bank and else- where money beyond the limit fixed by the city councils. This, he will assert, was the be- ginning and the end of his offending. Astothe way the money was lost Bardsley will throw the whole responsibility npon the Keystone Bank, He will take the position that the loss to the public funds through his trans- actions is only £1.045.000, and that part of this is recoverable. He will say that he became aware a long time ago of the fact that the pub lic money which he had deposited in the Key- stone Bunk had been lost there. As he bra technieally violated the law in making the de- posit he could not say anything publicly about the matter. He therefore took money from other funds to meet the payments coming du from the funds which had been lost. h payment thus taken has been added to the original loss until the alleged total of $2,200,000 is reached; but, as a matter of fact, the actual Joss ix only $945,000 for the original due bills and $100,000 for another matter. ‘This other matter came about from his efforts to recover himself when he found that the bank had swallowed up the 945,000, and is repre- sented by the $100,000 worth of West Chicago street car stock, which was discovered the other day. He bought this stock with the public funds with the expectation that its rise in value would enable him to restore some of the miss- ing money and meet some of the payments as they came due. ‘This expectation was realized in part. He had also some reason to think that part at least of the $945,000 would be made good to him from other sources.
