Attorney General Miller has rendered an opinion that the President has the power to appoint the nine circuit judges created by the last Congress during the recess of Congress. The President has not indicated whether he will follow the opinion of his legal ad- viser or not, but great pressure is being brought ta bear to induce him to ignore it and call an extra session of the Senate to confirm the circuit judges © whose names he will then send in. The question of the President's power in recess appointments is not a new one. A like question arose during Mr. Cleveland's administra- tion in regard to the appointment of members of the interstate commerce commission. Solicitor General Jenks held that the President could appoint during the recess, taking the same ground that Attorney "General Miller now takes in regard to the appointment of — the cirouit judges during the recess. Tt is poinved ont that the appointment of Judge Bestty in Ideho as one of the fine circuit judges, provided by the law during recess’ of Congress, has no bearin the matter. The principal | matter of business during the session was the report read by Presiding Elder J. W. Dans- burg. It showed a gratifying condition of things in his circuit. Presiding Elder H. A. jarroll also read his report and Dr. Payne A resolution to establish a local society for chureh work, stirred up the conferenee, but it ! was laid on the table after it caused a good deal of warm discussion. The first case brought under the anti-cigar- ette law wax called to the attention of Judge Miller in the Police Court this morning by Prosecuting Attorney Mullowney. ‘The defendant in the case was Mrs, Elizabeth Soper. Judge Miller asked what penalty was provided by law and Mr. Mullowney said that the law fixed the penalty at frora €2 to $10 and that ‘The judge svid that €5 was about the happy mediuin of the penalty provi it was probably enough for the first offense. ‘The warrant issued against Messrs.
