It is assumed that +because certain things seem to certain persons to be established as the result of the elections of last week the Present Congress is bound to take cognizance of popular opinion so far as to change existing Jaw to accord with supposed popular judg- ments. If this obligation existed it would change the kind of representation heretofore obtaining under the Constitution in this repub- lic to a representation like that of lib- eral imonarchies where the government changes with changes in the com- plexion of the popular house of the legislature. The fact is clear that each Congress is its own master for all constitutional purposes under the peopie who constituted it. No other people can or should be considered its creator. The Congress chosen in 1888 must legislate without dictation except so far as it may be willing to receive suggestious, Under the Constitution and in accordance with the North American theory of republican govern- ment representation and not litera! instruction is the rule and practice. There is no direct ref- erendum as to ordinary laws, as in Switzerland. ‘The only consideration which will address it- self to the Fifty-first Congress in determining whether it will adhere to or modify its course f action is that of expediency. The party in control of it may decide that the recent elec- tions furnish to it no warning, that the causes of defeat were so complicated and varied that no modification of its policy can meet the case, and that public sentiment upon the great questions at issue between the purties, if expressed at all im the balloting, was based upon a misunder- ing which may be removed before another election, In this event the Fifty-first Con- gress will stand by its guns and carry out the campaign which it has planned. If onthe other hand itis decided that the election is an unmistakable expression of public opinion upon certain points now at issue be- tween the parties, so decided as not to admit of reversal within two years, then to ignore the warning would be to invite certain defeat, and no politician or legislator would be so foolish as to take this course. While in this event the Fifty-first would not be under any obligation to anticipate the Fifty-second Congress, there would be excellent reasons why the republican leadership in the former body should somewhat alter its course. Absolute consistency in things political is treated as the virtue of fools only. a The loss of a fine cruiser, H. M. S.
