The old law relating to aliey subdi- visions provides that upon the filing ofa plot, &c., the mayor shail make application to the marshal, &c. The point raised is that the Commissioners are not the legal successors of | the mayor. It is understood that there have | been several cases im which one of the justices | of the Supreme Court of the District has held that such alley assessments are void. In view of this case and some decisions of the General Term invoiving the same principle Assistant Attorney Thomas has advised the Commis- sioners that there is enough in the point to make it doubtful whether they can legally in- augurate proceedings for the condemnation of alleys, He suggests that in view of the un- certain condition of the law on the subject that ‘® bill be prepared on the plan of the old law if the Commissioners think well of its machi ery, to be presented to Congress for its enact- ment or thata section covermg the point be engrafted on the pending bill with reference | to the condemnation of land for sewers, &c Mf the bill is not too far along on the cale: dar.
