A second-hand dealer in clothes and one of hie colored customers met at Pennsylvania avenne and 9th street on the 4th of July and engaged ia a squabble over a pair of trousera Policeman Barney arrived after « large crowd had collected and acted as arbiter. No arrests were made, but Special Police Officer Henry Davis appeared and m attempting to get the crowd back used his blackjack on Wm. MeIntire’s arm, but did not injure him badly. A warrant was issued and the case was called before Judge Miller today, Davis being charged with asswult. The facts as already stated were proven by witnessés and Mr, Armes for the prosecution argued the case. PROSECUTOR ARMES THINKS THE SPECIAL UNFIT FOR WIS OFFICE. Mr. Armes said that it was his duty to up- Wid tbe action of the police officers in the performance of their duty. When, however, an officer oversteps the bounds and goes too far he should be reported to police head- quarters and dismissed by his superior offi- cera. In this case the man acted without dis- cretion or common seuse, He did what be su, posed was assisting the other officer, but ‘used his own means on an unoffending crowd; used bis blackjack in a mupner which shows that he is utterly unfit for bis office. “What does the government claim in this case?” asked the judge. “Well.” replied Mr. Armes, “the defendant acted. as he supposed, in the line of his duty, aad the proper piace for his trial is before the Police trial board,” “That's my view of the matter, too,” added Mr, Carringion. JUDGE MILLER COMMENDS MR. ARMES’ COURRE. Judge Miller referred to the action of Mr Armes as showing a degree of intelligence and cousideration on the part of the prosecutor that is worthy of commendation. The judge said it was a grand thing to see such an officer rive and present a case so faicly instead of at- tempting to put oly one side of it before the court. It shows, said the judge, that the prose- cutor is untainted by corruption and is doi: ~*= best toward the enforcement of law an order im the community. \. THE GREAT MISTAKE PEOPLE MAKE in the cases of police assaults on citizens is that they are educated to the belief that the Ofticer is dragging in an inoffensive citizen, ‘vhey seem to entirely forget the fact that all these arrests grow out of the arrest of a per- sum fur some unlawful act. The judge spoke atconsiderable length about the arrests of criminals and others by officers and the will- ingness of the prisouer to assault and attempt to get away from the officers. After speaking Of the law and indorsing the statement of Mr. Armes the judge added: “I am not going to uphold an officer where be oversteps the bounds of discretion or where he strikes a blow to reseut some insult or wrong, but, on the contrary, where an officer illegally aud wilfully assaults a prisoner the court going to punish him ten times as vy as inthecase of acitizes. In this case,” the judge concluded, “there is « lack of proof to show malice, either ex or im- plied ou the part of the defendant.” The case was dismissed. —__—_—— Return of the President. ‘The President. accowpanied by Mr. and Mrs. Halford and Miss Halford, reached the city from Cape May Point at 3:50 yesterday after- neon in a special car attached to the limited ex- press. Charles Leonard Sentenced for Man- slaughter—A Sentence Set Aside, Ete. In the Criminal Court, Chief Justice Bing- ham, this morning the case of Chas, Leonard, the young white man, convieted June 23 of manslaughter, under an indictment for the marder of Geo. Wm. Sayers, a companion, by eutting him on Sunday, February 23, causing death March 1, was taken up aud the motion fora pew trial was withdrawn, ‘This is the case where the cutting took pl.ce over a game of crap near thé K-street bridge over Rock creek, Col. Christy, his counsel, called the court's attention to the youth of the prisoner and his good character and appealed for a light sent- ence. Assistant District Attorney Lipscomb said in reference to the statement of good character that the evidence was that Leonard was drunk and engaged in the playing of crap on Sunduy, aud the case was one bordering close on to the erime of murder.
