Ross Perry has submitted to Cure BILIOUS and the House District committee the following Nervous argument in connection with the proposed amendment to the mectianic’s lien law: 25cts. a Box. OF ALL DRUGGISTS. A secret lien is given by existing law in the District of Columbia upon a house and the ground on which it is built in favor of the con- tractor building it, and also of all subcontrac- tors, material men, journeymen and laborers concerned therewith. This lien begins with the commencement of work on the build- ing and continues until the expiration of three months after its completion. In fact, a conspiracy between contractors and material men to defraud own- ers is the result invited by this law. It is a di- rect but subtle temptation to dishonesty. ‘THE EVIL EFFECT. 10. The evil effect of this law bears more heavily upon tne comparatively poor. The rich, if they are wise, make no contracts with- out legal advice; moreover, they build much and know the Jaw in part at least. But the man who builds a modest home, the woman who has repairs done upon her house, these consult economy instead of a lawyer.’ They know nothing of this mechanics’ lien law. It is natural to them to think that when they have paid their contractor they have dono all that any law can require; when they have to pay over again it hurts them and it burts their respect for their country’s laws and law makers. Al, The constitutionality of this law is more than doubtful, A recent law of the state of Pennsylvania, containing substantially the same provisions, has been in fact declared un- state. Itis abhorrent to our sense of justice that an obligation should be imposed by the law upon a man who not only never incurred it but who has in fact contracted and discharged another obligation negativing the existence of the one imposed by law, and it is especially ab- horrent that this obligation should be imposed at the instance of a subcontractor who has vir- estopped by the ter the owner and the original contractor, The subject is now before your committee, We ask that this law may be so amended as to be clearly constitutional, as to be beneficial to those sought to be protected by it without at the same time being a source of injury to the inocent and of temptation to the dishonest. We only ask for notice. The wages of the carpenters, bricklayers and other journeymen and laborers of every description «.n readily be protected. It is the —_— universal custom in this District to pay them weekly; with Saturday afternoon comes the parmaster; if he docs not come the labor unions step in and stop work on that and all other buildings in the hands of that con-} tractor if any member ask their aid. This of itself is in truth a sufficient protection. Never- theless, if thought proper, let them be given a lien for two weeks’ wages. To give it fora longer term would only be to encourage con- spiracies between contractors and subcon- tractors and workmen to postpone weekly payments for the purpose of making the owner pay these wages twice—once to the contractor, to whom he bas bound himself by contract to pay them, and once again to the workmen, whom he does not kuow in the matter at all, ‘The workmen do not suffer.
