In the trial for manslaughter in connection With the recent killing by the Baltimore and Potomac railroad of several persons at the Benning grade-crossing it was claimed by the road that no law requires it to guard grade crossings outside of the city limits. If this be the case, the sooner such a law is pro- vided the better. It is one of those exactions for the protection and relief of the public which should be imposed in granting such con- cessions as those asked by the Atkinson- McPherson bill. It is necessary for the public safety not only to extend the grade-crossing Jaw to the county, but to enforce it in the city. ‘The reports of the lieutenants of police re- cently published in Tar Stan show that at night and in the early morning while numer- ous trains pass in aud out, many city crossings are left entirely unguarded. ‘The records show that more than one handred persons have been killed or mangled by the Baltimore and Potomac road in Washington. In tome of these cases the train was running at an illegal rate of speed, as in the Golway case; in others the crossing was not guarded according to law, as in the Washington case; in several instances the collisions were due to the shunt- ing of freight cars back and forth in the illegal use of the streets as freight depots; in other cases the deaths were the apparently inevitable result of the existeuce of grade-crossings in a ‘Sho attention of the local authorities has been repeatedly called to the fact that these laws forthe public safety are not obeyed or en- forced, and the attention of Congress and the railroad has been repeatedly directed to the fact that additional provision is necessary for the protection of the public by the removal of 2 part of the evil of grade-crossings through the lowering or elevation of certain tracks, The blood of victims hereafter sacrificed at these grade-crossings will stam the hands of the railroad, and would stain its soul if a cor- poration had a soul; and Congress, which after notice fails to legislate for the protection of the people, and officials responsible for the en- forcement of existing laws who fail to enforce them, will be accessories to manslaughter, a Washington's smooth streets enconrage fast driving, but the streets must of conrse remain smooth and cannot be disciplined, In- adequacy in the number of policemen, and re- luctance on their part to make arrests of fast drivers, which, they claim, result almost al- ways in nothing. encourage reckless driving.
