The opening session of the sixth annual lishes what purports to be a trie story of the proceedings of the jury in th “ronin case, It says the jury first freely discussed the evi- dence. Several of the jurors, after a consultation pre- & series of questions concerning many Juiver's utterances in the rooms occupied at the hotel. These questions were put to him in pope succession. ‘They all dwelt on remarks he had made to different jurors about the case. CULVER PERSPIRED. Cuiver sat through the ordeal like one in a dream. Big beads of perspiration broke out on his face and forehead. His body trembled and his bands shook. He made a motion once as if to break away from his stern inquisitors, but, sinking back in his chair in a hopeless sort of a Way, remained motionless until the reading was concluded. He made noreply to any of the jaestions nor did he comment on them, When reading was finished he wrote a letter to Judge McConnell, complaining that his char- acter and integrity were being assailed and asked for protection. The judge replied that he } could do nothing for him. After another long argument a third and fourth vote was taken on the same question as the first and second. The result wus the same, Culver voting no. After @ fifth ballot, which was like the preceding, debate was resumed. The others gave Culver no rest atall, Three or four were after him at | the time, though he begged piteously to be let alone. Finally, Saturday night Culver took the a aside and told them that if they would | let Kunze and Beggs go free he would vote to find the others guilty. The proposition w: ted and all went tosleep. Eariy Su jot was taken resulting: Beggs guilty, 7; ae 5; Coughlin guilty, 12; U sullivan guilty, 12; Barke guilty, 12; Kunze guilty, 8; not guilty, 4 CULVER AGAIN MAKES FIGHT. This result was unexpected to everybody, Culver charged the others with violating their agreement, but they informed him that no | agreement had ever been made. He wanted to | compromise, but the others insisted on pro- ceeding as they were. Beggs’ case was then taken up. On the seventh ballot only two voted guilty, and on the eighth Beggs was ac- quitted, The result pleased Culver, and he | became more affable. After an argument it} was agreed to find Kunze guilty of man- slaughter and on the tenth ballot it was so de- cided. On the thirteenth ballot this sentence was fixed at three vears. On the question of hanging Barke, O'Sullivan and Coughlin the ballot was ten for and two against. On Burke alone eleven yeas and one no. Culverat once stood between Burke and Conghlin and the gallows, but was supported by one other in O'Sullivan’s case. Culver argued strongly that fourteen years was sufi and threatened to withdraw his vote on guilty if the others in- sisted on the death penalty. Monday morning Culver agreed to a twen! ve year sentence, and a ballot resulted: Aye. eleven; no, one. Finally, at 12:30 Monday, the thirty-lirst ballot Was taken on the proposition to send the mur- derers to the penitentiary for life. The vote | ‘was seven for aud tive against. New Yor, Dec. 28.—The stock market opened this morning with more animation in the regu lar list than on any previous day this week, and Lackawanna, Reading, Missouri, Pacific, Erie, Union Pacific, Lake Shore and St. Paul were all consp'~ously active. First prices, however, were geaerally from 34 to %¢ per cent lower than last night's closing ‘figures, and the drooping tendency of yesterday was continued, everything yielding small fractions in the early dealings, Union Pacific and St. Paul took the lead among the stocks of the regular list in this | decline, both losing % per cent from their last | night's figures, though Wisconsin Central de- clined an equal amount, and sugar retineries lost 1 percent to 5734. The method of . oe cars through overhead conductors is = system which actual practice has be a success, Of the overhead systems now employed the Commissioners believe the one used by the Eckington and Soldiers’ Home railway company, in which the conductors are supported by poles situated in the middle of the street, is the most satistac where there is sufficient width of carriageway for its em- ployment, AS SAFE AS ANY MOTIVE SYSTEM. “The Commissioners believe that the elec- trical system employed by this railway, the electro-motive force of which can never ex- ceed 500 volts, is as safe as any motive system ever employed by any railway. ‘The Eckington railway has never had any accident whatever resulting from its employment of electric mo- tive power, and the Comimiasioners believe this to be also true of all other electric railways now in operation throughout the United States. OVERHEAD WIRES SHOULD NOT BE ALLOWED ON NARROW STREETS. “The Eckington railway has been so admir- ably constructed and equipped, its operation has been go satisfactory to the public and its success has been so much greater than its most sanguine friends could have anticipated that the Commissioners say without hesitation that the extensions provided for in this bill are Seabee to the public interest. For some time past Major Raymond has been busy preparing @ memorandum relative to the indictment against the District Commissioners for allowing illegal railroad tracks in South Washington. This memorandum was presented to the board at their session this morning and considered by them at length. Thememoran- dum takes up each count in the indictuent and goes into a complete history of it, In one case it was found that they were indicted for allow- ing anillegal switch to remain which in fact had been removed some time ago. Then, again, they were indicted for allowing the side track crossing E street at 133¢ to remain, when in truth it was authorized by an act of Con- gress approved September 27, 1898. The Com- missioners will visit the points where the al- leged hae tracks exist and then make their replv to the indictment, —__—»—___ THE BENNINGS DISASTER. A Suit Against the Railroad Company | ® for $10,000 Damages. Richard H. Pratt today, by Campbell Carring- ton and Irving Williamson, filed a suit against the Baltimore and Potomac railroad company for $10,000 damages, The plaintiff claims that he was a passenger in the wagon or stage which was struck by a train near Bennings on the 14th instant, when four persous were killed outright and one other injured, the said acci- dent being caused by the failure of -dsfendant to have the gates closed, and that although he escaped with his life by jumping from the wagon he was burt and bruised by falling on bee track and by oue of the horses falling upon im, ——>—___ DISTRICT GOVERNMENT, BRICKS FOR SIDEWALKS, The number of bricks used this year for side- wulks and the paving of alleys promises to ex- ceed that of any previous year, ‘Lhe District has a contract for 3,000,006 of bricks, but upon investigation it has been found that this is not | enough, so another contract is being prepared | for 70,000 more and advertisements inviting Proposals for same will be printed shortly, Indicted for Contempt of Court.
