JUDGE MILLER'S KNOWLEDGE OF MODERN LEGAL PROCEDURE ENABLES HIS CLIENT TO ESCAPE, BUT THE RECEIVER MUST SUFFER—TER TA~ KOMA CITY COUNCIL IN SESSION. The Takoma Park city council met last night in spite of the terrific downpour of rain which made every place in the vicinity of Washing- ton. Many members of the council were ab- sent, but there was an active surplus over and above the quorum of 37. The chairman of the council—B, H. Warner—was absent, and after his place had been temporarily filled by the election of W. ©. Yeaton, the absentoe was fined $10 for, as Mayor Heaton put it, ‘“‘warner- ingaround when there was business to be at- tended to.” Gen. Kniffin, in command of the Takoma Park militia, then announced the appointment of the following officers on his staff, and the council approved the same: Wm. Yeaton, adju- tant genera! Gustin of the city of Washington, There was consid- erable debate over the remuneration attaching to the office, and it was settled in a mutually satisfactory agreement, by the terms of which the executioner is to paid by the job—so much a head, as it were. A very interesting part of the proceedings was the discussion on OFFICIAL ADVERTISING. It could hardly be termed a discussion be- cause, with but two exceptions, everyone pres- ent openly stated that there was but one news- paper in which to advertise and that is Taz Srarn. The two bran” tarred agreed that Taz Sran was undoubtedly the best advertising medium to be found in a Sabbath ty 2 's jour- ney on a Baltimore and Ohio limited, but one of them was opposed to Taz Strap because it} failed to support St. John in his prohibition and pro-St. John campaign, while the other based his antagonism on the ground that Tu Srar had refused to endorse ‘The Board of Shanty Hill” (Mrs. Sarah Ulrich Kelly) in her struggle for position and salary as poet-laureate of the United States. The objectors were — pty hustled out of the meeting by a irge badge, the motive power of which was the chief of police, and Tue Star was unani- mously declared to be the onl; mn and the sole advertising medium of the Takoma city council, THE MAYoR's COURT, The council then adjourned to give way to the mayor's court, which was opened with the aid of Crier Purman’s voice—piercing as a can- opener. Mr. Purman’s preliminary remarks, commencing with “Oyez” and ending with “God bless the commonwealth of Takoma and the honorable court” was evidently regarded as humorous, for several people smiled &udibly when he got through with his speech. Mayor Heaton put on his glasses and while City At torney Lamar was reading the papers in the case of the city of Takomaagt. William Lewis, polished his badge, The prisoner was placed in the dock and beneath a _prepossessing exterior he evidently concealed a hardened disposition. Several times did he wink at ac- quaintances in the court and on one occasion he placed his tongue in;his cheek tosuch an3ex- tent that his features were distorted and much merriment ensued. Lawyer Yeaton, for the defense, moved to quash the information and everything else there was in the case on the ground that the court had no jurisdiction, but Mayor Heaton told him the court did have jurisdiction ‘and don’t you forget it.” THE CRIME, The case was an intricate one. The defen- dant, Lewis—a bright boy of ten or eleven years—had found two ducks in the vicinity of his home. He failed to find an owner for them, sohe took them home and put them ina chicken coop. His mother insisted on his re- leasing the birds and in obedience to her eshe took them out of the coop and rted them off the premises. While still in ossession of the wanderers he met one Edwin (. Brown, a gentleman from New York, now summering at Takoma, and to him he sold the ducks for 50 cents. Subsequently the ducks were claimed by G. L. Favorite and he took them away. Upon information received WARRANTS WERE AT ONCE ISSUED by Mayor Heaton for the arrest of Lewis on a charge of petty larceny and for the arrest of Brown, the latter's offense being the purchas- ing of the ducks. knowing at the time of pur- chasing that they were not the property of Lewis. Lewis was without counsel, so the mayor as- signed Judze Thomas Miller to defend him and there was thunderous applause when the well- known Police Court administrator of justice stepped forward and shook hands with his client. The judge saw at once that his case was not a good one #0 he looked around for a loop- hole. In half a minute he had fixed up an agreement with City Attorney Lamar and a few seconds later he announced that Lewis would lead guilty and be used as a witness against ene Mayor Heaton at once imposed « fine of one cent, which was paid by Judge Miller. Then the Brown case came up and it was full | of funny incidents, Attorney Yeaton, for the | defense, was very active, but the prosecution and the mayor were too many for him. XXXIV, §73: ‘Verdict . evidence afterward is the rule, but if the | evidence shall by chance be heard first it shall | have no effect whatever upon the verdict.” THE JURY DELIBEBATES. The jury retired to a large table, ate ice cream at the prisoner's expense and then re- turned a verdict of “not guilty.” The court promptly reversed the verdict and sentenced Edwin T. Brown to be hung by the new hang- man as soonas the culprit and the hangman found it mutually agreeable and convenient. ‘The proceedings were pleasantly enlivened by vocal selections of the highest order, ren- dered by a glee club composed of Prof, J. T. Layton, Dr. fT. L. Upshaw, J. C. Nalle, A. L. Jackson, Ignatius Jackson, J. A. Simms, jr., and J. W. Stevenson, all members of the old heus glee club. T. TRIENNIAL CONCLAVE. Meeting of the Finance Committee— Knights of Various States Heard From. The finance committee of the Knights Templar triennial conclave committee held their first meeting since the reorganization last evening at the headquarters in the Atlantic building. A number of the members were kept away by the heavy rain. Those that were Present made encouraging reports of the results of the systematic canvass of the city which was Degun last Monday. It was stated that a ready ‘and generous response was the general expe- rience of the canvassers and the committee feel very much encouraged. It is the intention to prepare for publication next week a complete list of the subscriptions received up to date. Mr. James E. Munson, grand recorder of the Grand commandery NorthCarolina, reports they ere trying to arrange a battalion of Knights Templar to attend the conclave. E. R. Sir Knight R. G, Reed, M.D., of Woonsocket, R.L, was at headquarters the same day. He was in the city for the purpose of making final arrangements for the care of Woonsocket com- mandery,No, 23,of the same place. The doctor visited some of the Masonic bodies in the tem- ple, was greatly pleased at his reception and would have prolonged his vislt in the city, but was fearful that if a much longer stay was made his Woonsocket patients might all be well on his return. Sacramento commandery, No. 2, Sacramento, Cal., advises the committee that that they will come via Baltimore and Ohio and will sleep in the Pullman cars at Eckington. They expect to bring 50 knights and about 30 ladies and will have headquarters in the central portion of the city. Sir Knight Jno, Schuyler, jr., eminent com- mander, and Past Em. Commander Jno. T. Beardsley of Hospitaller commandery, No 46, Lock Haven, Pa., were in the city on Saturday looking for quarters for about 40 knights and a band of 20 pieces, They had no trouble in securing suitable accommodations, Potomac commandery,No. 6, of Charlestown, W.Va., report they will be here October 7 with 20 knights, Baldwin commandery,No. 2,S8helbyville, Ind., state they will arrive Saturday, October 6, and wiil bring 30 sir knights and 20 ladies. Snead DISTRICT GOVERNMENT. A CIRCLE FOR NORTHEAST WASHINGTON. t. Symons today, in a letter to Major Ray- meek, recommended that in the improvement of Maryland avenue between 11th and 13th streets northeast a circle be provided for at the junction of Maryland avenue, 12th and F streets. These streets, he says, are respect- ively Maryland avenue, 160 feet wide; 12th street, 112, and F street 100 feet wide. A cir- cle, he says, could be very readily put at this intersection of 75 feet in diameter without en- croaching on vvahiens property. Twelfth street, he says, runs directly north from Lincoln park which is one reason for desiring to have a cir- cle at this point. The circle, he says, if estab- lished, would also divide approximately the distance between Stanton square and the inter- section of the Bladensburg and Benning’s roads, and would give a beauty spot in north- east Washington which would add very much to that section of the city. Itis thought the circle will be provided. THE RESURFACING OF PENNSYLVANIA AVENUE. Capt. Symons today wrote to President Hurt of the W requesting that he put a force of men at work on the avenue, commencing at Ist street and working west. He says in his letter that he is very anxious to have the avenue in shape by the time of the Knghts Templar conclave, and if he (Hurt) will put this extra force of men at work he (Symons) will see that another gang follow them up resurfacing. CRYING OF SUNDAY NEWSPAPERS, For some time past the Commissioners have been receiving complaints against the crying of papers by the newsboys on Suudays. The last complaint came from Dr, T. J. Childs, His pro- test is vigorous. In conversation with Commis- sioner Douglass upon the subject he said that there was no doubt but that the crying of news- papers on Sunday wasa great nuisance. The churches, he said, probably suffer the most, the service being frequently interrupted by’ the noise.
