DISCHARGED ON & WRIT OF HABEAS CONPUS—JAKR KILRAIN HAVING 4 HARD TIME AVOIDING AR- ‘REST—HE QUITS THE TRAIN IN INDIANA AND TRAVELS OVERLAND, THE SHERIFF IN PURSUIT. After the arrest of John Sullivan in Nash- ville, Tenn., yesterday,es stated in Tax Star, & great throng of people gathered not only in front of the police station where Sullivan and Johnson, his backer, were taken, but also in front of the jail, where many thought the big one would be put forsafer keeping. It was necessary to station a guard at the door of the station to keep back the excited and curious people, and hose was finally tarned on to in- duce them to scatter, Sullivan and Johnson were taken into the chief's private office, with # guard of several officers to watch them. A writ was then applied for to Judge Mc- Alister of the circuit court, Defendant's pe- tition for writ of habeas corpus was read, stat- ing that he had been arrested upon no process known to law and held without any charge against him, and without shadow of legal au- thority. He declared that he had committed no offense against the laws of Tennessee and was not subject to legal restraint. He had committed no felony in this state or any other. The answer to this petition recited that Chief of Police Clack bad positive information that Sullivan did commit @ crime in the state of Mississippi, and that he believed this crime to be a penitentiary offense to the laws of Missis- sipi. Counsel discussed at length and finally Judge McAlister rendered his decision. He was very emphatic in his opinion that to hold Sullivan longer would be s most arbitrary acton the of the court; that the officers had arrested him without warrant or authority of law; that mi were not extradita- ble by the rulings of Tennessee courts and by precedents of Gov. Taylor. He therefore or- dered Sullivan released. There was an im- mense crowd present and the decision of the judge was greeted with great applause. Some friends in Cincinnati saved Jake Kil- rain and Charley Mitchell from arrest last evening. The Kilrain party, who were on the Ohio and Mississippi express from St Louis, received a telegram at Vincennes warning them not to pass through Ohio as they would surel be arrested. They heeded the advice and teft the train at Seymour, going from there to Owensboro’, Ky., where they got the Chesa- — and Obio express for the east. Chief of lice Deitech received a dispatch from Gov, Foraker ordering him to arrest Kilrain and Mitchell when they reached the Ohio line, The cbief sent two detectives to Lawrenceburg, Ind., 25 miles from this city, where they learned when the train from St. Louis arrived that the birds had flown. In anticipation of seeing the arrested pugilists a large crowd gathered in the Central Uuion depot. A portion of the Sullivan ty who came through Mississippi arrived in Cincinnati last night. In the crowd were such well-known sports as Jack Barnett, D: lurphy, Sullivan's bottle-holder; Frank Moran, Joe Coburn, Lon | Tracy, Prof. Donovan of Boston, and the St. Joe Kid) They had heard rumors of the cham- pion’s arrest and were very much exercised over it. Barnettand Murphy made a bee-line for the telegraph office to confirm the news, and were much relieved to hear that John L. had been released on a writ of habeas corpus. Muldoon, after reaching Louisville, decided not to leave Sullivan in the lurch, and took the next train back to Nashville. One of the bruisers said last night: “If Sullivan and Kil- rain can only reach New York they will be all right. The eevee authorities can’t geta requisition on them there.” THE SHERIFF AFTER TREM. Kilrain and his party turned up unexpectedly at Columbus, Ind. At Seymour the news reached the party of Sullivan's arrest. The announcement came unexpectedly and dis- tarbed Kilrain, who evidently feared that his arrest would soon follow. A conference was held, resul| in their resolving to leave the Ohio and Mississippi train and go to Columbus, and, if possible, reach Deore another road. Jake Kilrain’s friends in New York city are incensed at the reported desertion of Jake by his friend Mitchell and are generally inclined to think that the reports are true. They say that when Mitchell was last in this city, upon being asked aboutKilrain’s condition, he declared that it was perfect and that he was giving him the very best attention. But, at the same time, Charlie was spending considerable time here, trying to beat the races when he should have been training Kilrain for the fight. Jake has now the sympathies of some of Sul- hyan's best friends, who never could tolerate Mitchell, and have all along expressed surprise that Jake should have taken him as a friend, knowing the Englishman's unpo ity in America. The New Yorkers who have returned from the fight confirm the stories already told of Mitchell's peculiar condnct toward his friend. Steve Brodie says that he never saw a second show such neglect of his paae when atten- tion was most needed, while another member of the New York delegation declares that he himself was the only man who made any effort to render Jake comfortable on the close of the battle. That Kilrain was not properly attended to before the fight and that he was shamefully po erp afterward, most of his friends firmly eve, although it is doubted if he could have beaten Sullivan had everything been different. Steve Brodie said yesterday: “Kilrain is a game man; one of the pluckiest I've ever seen. He is also the quickest man with his head that lever saw, He ducked the big fellow's blows so pretty and neat that Sullivan himself ad- mired him. “In the fifth round the fighting was pretty near even. While they were fighting this round some one shouted: ‘I'll bet $200 that Kilrain wins! “Sullivan stopped short. Pointing his big hand at the man, he roared out: ‘Hey, John- ston, there abet for you! Then he went on fighting. “After the eighth round Kilrain was licked. He knew it andso did his backers, but Mitchell kept him at it. “When the ronnds were finished Sullivan would stand up in his corner, while his three attendants would fan him with big towels wrung out in ice-water. “Kilrain would sit in his corner with bowed head while they fanned him with a single palm- leaf fan, It was awful hot, too, “Mitchell sent Denny Butler out to find the police and have them stop the fight.
