Witness was the almoner and also a Judge, The custom was to try members before the council, Witness testified that a cer. tain court fined Krause $75, and he was suspended until the fue was paid. Witness said that Mr. Wilde and Mr. Linden made some remarks. They said “it was NECESSARY TO DOWN THIS MAN KRAUSE by making him pay the $75.” Witness sald they referred to him as “this man,” and did not call him “brother” as was customary. Mr. Moore objected to this evidence, and the court excluded it, ‘THE CIRCULAR. ‘Mr. Worthington read a circular bearing the seal of Washington Musical Assembly, notifying the members that “Krause was tried before court on Sunday, July 17, 0n two changes, and had been found gullty of both charges. In the first case he ‘was charged with not complying with the Assem- bly’s order to withhold a certain part of the en- gagement money from Brother Jimerson, when- ever employing the latter, and turning over the mouey $0 withheld into our treasury. A ne of | $25 was imposed. His second offense, for which an additional fine of $50 was lmposed, consists in having unfairly underbid another brother, and Unrough this means having obtained the contract for furnishing music on the Lower Cedar Point steamer. It is further ordered that no member shali play with Brother Krause until he has fully settled the fine put on him by the court and every member violating Ubis mandate will be dealt with strictly according to law. lf, Schutter said that he had received such a reular. Mr, Moore cross-examined Mr. Schutter, and he testified that he did not know anything Jaws when he signed his name to the book. He filled the oMice of judge for about eight months, ‘Witness tried cases, but did not suspend inembers, He was not judge of the court which fined Mr, Krause. Witness was not interviewed by Mr, Krause about the time of the trial Witness had ‘not joined with Krause to break up the assembly. He did not know that he had violated an obliga- Yon in telling what had passed in the ‘Witness Was not positive that Mr. Wild was pres- ent when Krause was fined; but he was present ‘when he told the committee to go to the execution chamber and get all they wanted. “I would have to have @ head like a balloon,” said the witness, “at I could tell all that was said.” "Mr. Krause was not mentioned in the instructions, but Mr. Wild used nis name in the meeting, saying, “he must be downed.” ‘The, committee was not appointed r the expulsion of Krause. Re-direct.—The committee was told by Mr. Wild tw let the people know that Krause is suspended.
