Todd in the New York Avenue church at 10:15 this morning. For the en lightenment of the presbyteryza large map of the Nokesville vicinity showing the roads and all Points involved in the charge against Mr. Todd ‘and his defense was hung up in full view. It was about 10 feet by 12, and gave acorrect idea of the vicinity. The proceedings were opened with prayer by the moderator, after which the roll was called. On motion of Dr. Hamlin, the two vacancies on the judictal committee, cause by the absence of Dr. Fullerton and the tof Dr. Childs as counsel for the accused, were filled by the ap- ‘ointment of Dr. Chester and Mr. Peck. Dr. Childs, for the prosecution, announc:d that there were no more witnesses on ‘side, aud the moderator called on Dr. Sunderland to begin the defense. AFFIDAVITS ADMITTED. Witness described his. satchel, Saying he usually carried his sermons, his comb and brush, a Testament, and sometimes a shirt; these articles fill the Dag. (The bag was here ‘produced. It resembled a sinall-sized mall- sack, being of leather, Witness thought a Small thin lap-robe might be carried in the ‘bag, but not with the other con- tents, He never carried alap-robe inthe bag: never tried to put one init. On that trip witness wore a wide-brimmed hat, lined with green (the hat produced), as the sun Was hot and he wanted to protect his face. Witness said he was wei ‘the same clothes he had on on the 24th of May, ‘ON CROSS-RXAMINATION ‘witness said the clock struck 8 while he was seated ‘at breakfast at Heading’ When be reached Slack’s Mrs. Slack sald her husband had been gone two hours. In cold weather witness was in the habit of carrying a horse blanket rolled up and strapped to his saddle. On May 24th witness had no roll of any kind; had nothing but his traveling bag. On Monday, while waiting for Slack to get ready to accompany him to Reading's, Mr. ‘Todd took a walk inco the woods; though not a hes a student of nature, Hehad been told that ‘an ebony-stemmed fern grew there. On his walk he saw two ladies in a buggy, and went up to them. He chatted with them about twenty minutes, and they gave him two books to read. The ladies ‘Were hot members of his chureh, but were friends of his. Dr. Childs. “Have you any objection to telling who they were?’ Mr. Todd. “No, sir.” ‘The moderator deemed the question unneces- sary, and it was withdrawn. In response to other questions Mr. Todd said the ‘two ladies whom he saw in the buggy on Monday Temalued in the buggy during his presence; nel- ther got out of the buggy. Neither of them was Gressed like the woman described by Turner a3. having been seen by him in the woods on Tues- day. TESTIMONY OF PETER CURRY. Mr. Peter Curry was next sworn. He resides at Nokesville, near by the Presbyterian church. The church {son his farm. Witness isa Roman Cath- olic. He employed James Worder, Robert Turner Douglass Brent, and Elijah Siack’ to work in his- corn-fleldon Monday; on Tuesday, next day, all of them returned to work except Shick. ‘The Work of planting was finished about 9 o'clock Tuesday morning. Witness had lived there seven years and known “urner all that time. Witness had never known Turner to tell a falsehood. Witness met ‘Turner on Wednesday, the day after the all scene in the woods, Turner voluntarily told wit- ness that he had seen Mr. Todd in the woods with a woman the day before; said hedid not know the woman. Turner offered’ to show witness the spot where he claimed to have seen Mr. Todd, but, wit- ness did not go, There are about twenty-three acres of the woods, ‘Witness did not see Mr. Todd pass the corn-feld that (Tuesday) morning; did not hear any of the other men gay they saw him pasa. Witness was in the fleld until 9 o'clock that morning and would probably have seen Mr. Todd had he passed. ‘When witness met Turner on the day after the alleged scene in the w turner remarked that Mr. Todd spoke to him (I'urner) tn the woods, but he had refused to speak to him on other occasions, ‘On Tuesday morning witness saw Woodyard on horseback.
