April 16.—In the hastings court to-day the case of the commonwealth against W. W. Whyte, late teller of the defunct Planters’ and Mechanics’ bank, was called and the commonweulth’s attorney asked that a noile prosequi be entered. Whyte was indicted last January for making fraudulent entries on the teller’s book of the bank, whereby RB. A. Young was credited with having deposited at ditferent times funds to the amount of $6,900, when {n fact no such deposits had ‘ever been made by Young. For this offense Whyte has been tried twice, but each time the Jury failed toagree. ‘The ground upon which the nolle prosequi Was asked Was that the com- monwealth ey had_been- unable to ob- tain auy new evidence against the accused, aud that it was his belief that another trial would result fn the disagreement of the Jury or an ac- quittal and prove @ fruitless expense to the commonwealth. ‘The court thereupon ordered thata nolle prosequi be entered, but instructed the attorney for the commonwealth that should he be able to obtain any new evidence against the accused the prosecution could be reuewed, ee Wheat Continues to Decline.
