The Neuchatel Paving Company, which had large pav- ing contracts with the sued the District for about $20,000, on acconcon lease it sustained by the forced sale of certificates of indebtedness is- sued to it by the auditor of the board on account of work done under the contracts, which certifi- cates the claimant hypothecated to raise money to carry on the work, the board having no money to pay them; and they were gold at a great loss by he lenders of the money. The ground on which it was claimed that the District 1s Mable to make good the loss was that the certificates were hypo- thecated on the verbal Promise of Governor shep- herd, president of the board, to see them cashed in time to prevent their being sacrificed.
