Messrs. Corkh'll, Bilss and Merrick appeared for the government, Messrs. Wilson, A. B. Williams, Carpenter, W. 8. Smith and others for the defendants, The first case brought to the attention of the court was that of Rerdell, in which a motion was on Mile to quash on the ground of misnomer, his full name not appearing tn the indictment Mr. Merrick stated that Mr. Ker was now absent In South Carolina, and it wasdestrable that he should be present. He suggested also that Mr. Smith having an engagement to-day that the case 0 over till Saturday. This was to, and a like disposition was made of the case of A. E. Boone, one of the straw bond cases in which a motion to quash is pending. THE MOTION FOR A BILL OF PARTICULARS. ‘The district attorney then called up the motion fora bill of particularsin the caseoft Dorsey and others, Mr. Merrick said the government was ready to proceed now with the argument. Mr. Wilson said defendants would like a post- ponement of the hearing, as Mr. Totten had an en- eient in the Circuit Court. ir, Merrick said that the matter should be dis- posed of as early as possible, so that when the day arrived for the trial there might be no obstructions in the way. “The absence of Mr. Totten,” sald the court, “is not sufficient for a postponement, The stalwart counsel are here.” EX-SENATOR DORSEY PRESENT. Mr. Williams proceeded to read the motion, and after reading the first paragraph as to fictitious Rames, &., Mr. Ingersoll called attention to the presence of ex-Senator Dorsey, in whose case the recognizance had been forfeited. He remarked that he had taken the ground that the alleged offence was a misdemeanor, and it had not occurred to him that It was necessary for his clent to hear tite Indictment read, or to be present when the motions were being ‘argued. Mr. Dorse} having engagements in New Mexico, he (Mr. Ingersoll) had advised him that he could go. If any was in fault it was the counsel and not the client. He therefore asked that the forfeiture be ‘set aside. “The forfeiture will be set aside,” sald the court. Mr. Merrick suggested that the bail be renewed. ‘The court said the bend is In force. “We only desire,” sald Mr. Merrick, “that the party will be held.” “You need not fear,” said Mr. Ingersoll, “that we will not be here when wanted. All you’ want, and the highest of your ambition, seems to be bail, We'll stay as long as you.” ES have your word for that,” retorted Mr. ferrick.” Mr. Williams briefly argued that unless they had the information called for by the motion pending, they wouid find it impossible tomake a defence to contradict the witnesses. Mr. Wilson foliowed on the same side, citing sev- eral authorities. Unless they had this information, he held, they would be in the dark. MR. MERRICK AGAINST THE MOTION.
