Scofield, recently absconded, has net yet been completed. but it has progreased far enough to show that Scofield at least $1,000 In debt to the association. It is thought, however, that under the bond of Schofield oa which Mr. N. H. Shea and Mr. Houck, of Balt!- more, dre sureties in $2,000, the assoclation may ver aby defyiency. In the meantime, how- ever, Mr. Shea has sued the association on an account for over $2,700. Mr. Franklin Burlingame, the free lover. made his appearance at the Police Court to-day, hay- iog sworn out warrants against Chas. A. Eraey atd John S. Williams, charging them with as- saulting him on Tuesday, the isbh of the pres- ent mouth, at the same time of the a3siuits tr ed by this court last Friday. Judge Madiox, Isaac Cohen and others of the free lover's a330- ciate, were present. Mr. Weaver appeared for dfencants. Mr. Burlingame was s'vorn, and stated that he had, since he came tnto court tbls morning, come to the conclusion that Mr. Williams Was not one of the persons who as- Saulted him, end was sorry that he gave him 30 much trouble. The court immediately dis- charged Mr. Williams. Mr. Burlingame stated that last Tuesday, while he was trying to ge. possession of his little boy,on F street, between ist and 2d streets northeast, and while he was held by others, this young man (Erney) struck him on the back of the head, with his fst, causing Lim (witness) to release his hold on the boy. On cross-examnation, he stated that he was in front of Mr. Erney’s house (111 F street) at the time of the assault, bat did not have hoid of the boy’s throat. Mr. Erney, who is a young man, and decidedly below the average size, testified that on the evening in question his wife called him and told him that there was a disturbance on the sidewalk, and on going to the door he saw 1his nan, whom he did not Know at the tine, have the little boy by the throat. and tue little fellow was on his knees or the sidewalk, appar- ently suffering. The boy called witness by pbameé and begged him to release him. Wirtae3s then went to where Mr. Burlingame was and struck him uuder the ear, and Mr. Myers at the same time wrenched Burltngame’s arm, and the boy was released, Tne court remarked that a parent has the right to use a reasonable am unt of force to get or keep possession of his cbtid, and when persons lwterfere with a parent in Ubis matter they should use great discretioa and care in doing so. The court sald that if the defendant had actea from any bad motive he would have linposed a severe punishment; bu’ as It Was apparent that he acted from a natural and noble lunpuise on seeing the boy in the po- sition described, he did not deem It his dary to impose any severe sentence, but aa the derend- aut acknowledged the assault, he would have toimpose @ small fine.
