An attachment was Issued last week against funds of the defendant ia the case of the Citizens’ National Bank agatnst Elliot, held by 8 third party. The U.S. marshal being functus officio, the writ was served by some unauthorized person. On application to Judge MacArthur on Saturday he promptly quashed ‘the writ, intimating, however, that he was pre- pared to cesignate parties to serve such papers. Applications were made in several cases, and ex-Deputy Marshal L. P. Wililams and als son, Frank H. Williams, were directed to serve the Wri's of garnishment issued in them. Judg® Wy lle, in the Equity Court, had before adopted a sigiflar course as to cases 1a his court. There is much diversity of opinion in refer- ence to the action of Judge Macarthur, It 1s claimed by some that the wrlts of the Eqaity Court being directed to the parties laterested, may be served by othera than the marsha); that whe action of Judge Wy lle ls correct, but that in allother courts writs belng directed to the mar- Shal, they must be served through such officer. If bas been suggested that the Court in General ‘Term may appolnt a marshal for the time being, but the authority in the statutes limits itto “justices of the U. 8. circuit courts,” and the first section of the ee (605) reads, “The Words ‘cireult justice’ and ‘justice of a circuit’ When used In this title sbail be understood to =. the justice of the Supreme Court who ts allotted to any circuit.” Under this it ts claimed that no criminal nor common law writs can be served, which makes an imperative ne- eessity for the appointment of a marshal by the President. CRIMINAL COURT ADJOURNED TO THURSDAY. The petit jurors of the Criminai Court were called this morning and adjourned to Thursday, Owing to the absence of a marshal interfering with the transaction of business: assistant District Attorney Perry and the eourt stated that there was some expectation of having a marshal or otherwise breaking the dead-lock by that time.
