She testified to defen ant being frightened; to his haying a swelling on the side, and to his suffering from sunstroke when a child, and that while living tn Baltithore up to 1871 his mind did not seem to be right, abd he was taken from school in consequence. Jobnson testified to the injuries received by defendant and to evidences of hi3 mind being unsound. ‘There has been a series of misfortunes tor some of the people engaged in this trial. First Mr. Cook, the senior counsel for defence, was iil when the trial commenced; Col. Corkhill, the District attorney, next was contined for a week to bis room by sickness; then one of the jurors, Mr. Divine, become sick from erysiptlas, which necessitated a Suspension of the trial several days last week; and to day another juror, (Mr. Jonn H. Mitche 1.) appeared with a huge Dand- age about his left hand.
