Advertisements, orders for the paper by mail and otherwise, news, or any information OF business can be sent day or night, free of cbarge. ‘The Indiana Imbroglio. ‘The question of the validity of the late elec- tion fs agitating Indiana just at present, and even obscures the coming presidential election. ‘The lawyers of the state differ in opinion on the Subject, and as yet nothing has been deter- mined with regard to the matter. It appears now that only one of the amendments was brought before the etate supreme court in the case upon which it rendered a dclston. ‘That was the amendment relating to residence qualifications, and it was assuiued that the court's decision, to the effect that that amend- ment had not legally been adopted, carried with it the other two—one relating to registration and the other doing away with the October elec- tion. The latter ts the amendment which in- volves tie great question of interest in Indiana now. Itt ‘id that some of the Indiana demo- crats hold that asthe amendment relating di- rectly to the October election was not before the court, jatter’s decision could not have affected It; that, therefore, the court not having, im fact. decided that the amendment was not adopted, it must be considered as in force, and hence the October election was not valid. Ujon the basis of this opinion a test case has been ar- ranged aid fled before the governor, from whom {t must eventually go to the court. Tae tncumbent of an office has protested against the issuance of a commission, by the governor, to bis suc r, elected on the 12th inst., on the grounds cited above—that as the October election amendment was not really before the Supreme Court, the court’s decision upon an- other amendment cannot, by inference, be made to apply to the former. This will call foran opinion from the attorney general of the state, and upon his opinion the case will be carried before the Sup: e Court. It appears that the lawyers of the state differ in opinion, regardless Of their polities. Some of them hold that the October election was held under the color of law and tbat a future decision upon the validit; of the amendment cannot be made retroactive Others maintain that should the court decide the election amendment to have been adopted it Would invalidate the recent election, and others SUuIl edvise that it fs better to accept the late decision as final and proceed upon the a: sumption that It was proper. The latter course iscertatnly the best one to avoid contusion, troubie and perhaps a great deal of litigation; but where the interests of politicians and office holders covitiict with this view It ts reasonable to suppose y will not abide by it. Many of the leading lawyers of Indiana are assembled in Indianapolis to-day for the purpose of consider- ing this important question tn all tts phases and if poss.ble, to determine upon some dettatie Mme of action. The indications potnt to ancther election by the republicans, at least, of all the state, county and congressional candt- dates on the second day of November, in order to make sure of the result. This seems to be the policy of the republi{eans, and while, upon the face of things, It might appear that the democrats would be willing to try the October election over again—on the ground that they have everything to gain and nothing to lose by it—such is not the fact. Mr. English and the democrats who, with him, are interested in the presidential election, prefer to have the recent election stand. Their reaton for this policy is that, with the election for Congressmen out of the way deputy marshals cornot be appointed at the polis. They issist that the appointment of large bur of etection marshals, all repub- licans, contributed more than all other causes to Gemocratic defeat. Deputy marshais ca, under the law, only be appoinred at an election where Congressmen are chosen, and unless the late election shall be invalidated; there will be £O authorliy for such officials in Indlana nex ‘Tuesday wee Ta preferring to have te recent election stand, Mr. Engilsh is supported by those Gemocratic candidates generally who uccessini, they not caring to risk what they have secured tn another contest. About New York. ‘The presidential battle 1s to be fou State of New York. That everybody admits, and while the western elections have given all the benefit of the “boom” to the republicans, the democrats are strong enough In the Empire State to make a hard fight if they pull to- gether. The last election held tn New York occurred last year, when governor and state Officers were ehosen. Tammany bsited the Tegular democratic nomimation and ran Jonna Kelly for governor. The total vote polled for governor was 901,535, against a total of 1,015,502 im the presidential election of 1 Gov. Cor- hell (rep.) received 41s, dem.) Kelly (Tammany dem 566, Making the vote for Robinson and Kelly to- gether foot up to 453,35s—a majority over Cor- nell of 3 But these figures do not repre- Sent the difference between the democratic and republican vote,as shown at that electton. Both wings of the democracy supported all the regular ticket below the nominee for governor, Yet Haskins (rep.) for Meutenant governor re- ceived 455, against 435,014 for Potter, his democratic opponent. He received 43: against 450,651 for Seymour, democratic candi- date for state engineer, who got the highest ie Vote Cast for any Man on his ticket. Tau3, it ts shown that the repubitcan leutenant governor Was elected over 4s democratic opponent by 200 majority, while Seymour (dem.) had a majority 1.425 Over the highest republican candidate, are still other dgares connected with are confusing to any ealcu- lations of party strength, based upon the vote of last year and intended to apply to the com- ing lection. The greenback candidate for gov- ernor received 20,256 votes and the prohibitionist 4,427. The latter will be cast for the same cause this year, perhaps, but where the bal of the greenback vote will go nobody can tell. As many of the voters of that party have shown a disposition to get in with the winning side, Probably the republicans will this year get a majority Of those who voted for the green- Tne republicans have main- I’s minority when compared with the aggre gate vote for Robinson and Keily Was caused by his being “scratched” by a large minnber of voters of the party who called them- selves Independents. The republicans go fur- ther and maintain that last year the seratchers Voted tor Robinson, but that this year they will vote for Garfieid) The democrats say their Vote fell short because of the split in the party; that this division led many democrats to vote for Cornell who will vote for Hancock. In the election of 1576 Tilden got 521,949 votes to 459,207 for Hayes. Takiog the highest vote cast by each party last year it shows that the demo- Crats fell of 52,268 from 1876 and the repubil- Cans 50,954. Both parties are confident of Dring- Mpg out thelr full vote in the presidential elsc- top.
