Jobn Patch, brother of defendant, testified that defendant was married first in 1859, bein then 2 or 21 years of age, and there was a di! cuity with his wife, whom he aecused of alui- fery aud from whom he obtained a divorce. He shot a young man, whom he supposed had been committing: adultery with his wife. He was for a long time melancholy over ey affair. Mr. Wood recalled for defence:—Mr.j Patch is witness’ brother-in-law, and knows that he 1s a littte off on doctors attending his wife, having a Monomania on the subject. He was fre- quently talking on it, and he became much ex- cited on it, So much so that they sent for Apbyst clan to ascertain what was the matter wit! He said that Dr. Muncaser had come there to see his wife without he sending for him, and he did not think that any woman who would allow amale doctor in the rooin in the absence of her husband was any better than a prostitute. His wife was very fll at the timeof the visit, and whenever Dr. M’s name was mentioned he be- came very much excited. A deposition was read from Dr, Louis Mack- all, to the effect that he regarded Mr. Patch as having had an Insane impulse on the ‘subject of Dr. Muncaster's attending his wife. The defendant was then celled to the stand, stifled that he had resided In the city man having committed adultery with his wife, hat he met Pr. THE DEPUTY SHERIFF IN JAIL. ‘This morning Deputy Sheriff John W. Ritchie, of Prince George’s county, who was on Satur- day (with Messrs. Keese and Howell) adjudged guilty of contempt in connection with the ar- rest of S. Mayhew on a bench warrant from the state of Maryland, came up to this city with a number of friends, and a great effort was made by some of them to induce Judge MacArthur to relent. This he declined to do, and the deputy sheriff at once accepted the situation, and, sur- rendering himself to uty Marshal Williams, went with that officer to the fall and com- menced his term of 10 days’ imprisonment. The ma is of the emotional order, but the pathos is relieved by fine comedy touches in which the old Washing- ton favorites, Mrs. Germon and Mr. Denham, do some work. Mr. Downing’s “Sidney Norcott” is played with force, ané Miss Bockel is picturesque and effective as “Frane "Miss 's “Cicely Blaine” is judiciously acted, and altogether the play is given in astyle which should attract large audiences the re- mainder of the week. NaTIONAL THEATER.—The lively play, “My Partner,” is beginning to be appreciated. The lecture Wil be illustrated. CHARGE OF LARCENY AGAINST & YouNG Lavy DIsMissED.—In the Police Court, this morning, Miss Anna M. Nixon, a rather good looking young lady, a clerk in the Paiais Royal fancy Store, No.’ 1117 Pennsylvania avenue, was charged with ue jarceny of a pair of kid gloves valued at $1.75 from Herman Lisner, the proprie- tor of the store. Isaac Teeney, the'colored por- ter at the store, testified that he saw the young lady take the gloves from a case and put them into her pocket yesterday morning. Charles Anderson, a small colored boy, testified that Miss Nixon sent him to her coat for some change and he found the gloves there in her pocket. Miss Nixon took the stand and testified that she is the head clerk and has been in the employ of Mr. Lisner and his brother for about eight years, ‘and that she and the he porter have not been on very yy terms, as she has had to report him to Mr. Lisner for neglecting his duty. She positively denied having any knowledge of the gloves being in her pocket. ‘The court said that there was no evidence of a larceny, but re- marked that it was more likely that the porter put the gloves in her pocket, and he would dis- miss the case. James Young, assault on Celia Jones; $5. —__+e —__. The C. & O. Canal Investigation. BRADLEY T. JONNSON’S TESTIMONY. A sp 1 dispatch to the Baltimore from Annapolis March ¥3, says: Gen. Bradley T. Johnson was before the canal committee this afternoon. He claimed that three members of the committee were disqualified from actin; voting on their report when presented. ‘They were ‘George H. Williams, one of the defend ants in the pending suit; J. A. L. MeClare, pri- vate counsel for Mr. Gorman in matters ‘con- nected with the suit, and George Peter, one of the parties complained of in the bill of com- aint. Mr. Williams disclaimed any disqual- ification. Mr. McClure dented this, claiming that he was employed as counsel, and objeetion was Withdrawn. Mr. Peter was absent. Of the allegations contained in the bill of complaint that the canal had been used as a political ma- chine Gen. Johnson had the least personal knowledge possible, but furnished specifications and witnesses to prove them. He alleged that the canal’s affairs were shrouded in mystery. He had personal klowledge by an order of 1si2 that the publication of cpg d and quarterly Statements was required, and tats was only done for two years. ‘The contract made in 1877 with the Potomac Lock and Doek company, was in reference to the purchase of the locks at Cumberland, and the agreement between the George’s Creek railroad, Consolidated and American Coal companies and canal company was never mentioned in the annuel reports. On cross-examination witness said it may have been wise to build the outlet locks if the canal were out of debt, but it was illegal to de so with the bondholders” money. MARYLAND — LEGISLATURE. —The Maryland senate yesterday struck out the enacting clause of the bill to es all grants and donations to accademies and other sEsututions of learning. In the house of delegates the bill making Good Friday a legal holiday was passed under a sus- pension of the rules.” By a vote of 35 to % the enacting ciause of the bill requiring ballote to be placed in envelopes was etricken out. They had secured a chisel and some scraps o' iron and worked the beards off under the window of their room. They made use of their leisure hours under these boards, replactnj ng them whenever they stopped work. They h: been at this for three days, and had fixed upon Monday night for escape. The jailer suspecting that all was not right, made an’ examination of the premises and discovered a hole cut through the wall. They were all placed in irons and locked in a cell. A Saitor’s YARN.—A man came to the station house yesterday and said he wanted to surren- der himself. He gave his name as John Kelley, of Portsmouth, N.H., and said he was a sailor training ship Saratoga, but him at the marine hospital in nm, from which place he had run away. While on the ship he had been treated very badly by the crew, and he firmly believed that a conspiracy had been formed against him. He did not want to be sent back to the hospital, but desired to be returned to his ship, where he could serve out his time, and draw the money due bim, which he could not do unless he was allowed to report for duty. It could not be de- termined whether the man was sane or not, as he was very excited, and kept pledging his word and honor that he had pot been gulity of mutiny. ‘The man was locked up in the station house and was sent back to the marine hos- pital to-day.
