(Laughter. } After the seconding of he previows question an effort was made by Mr. McLane to adopt a quick and easy solution of the difficulty by in- sisting as a question of privilege, that under rule 9 the highest question of privilege was one affecting the rights of the House collectively. It was the first onlin of the House to main- tain the integrity of its © having been tm} propery referred, he moved, as aquestion of pi n revision of laws be instructed to report it back forthwith, and that it be then referred to the committe? on ways and means. Mr. Garfield remarked that that would settle the whole business, and he was willing that the execution of the previous question should be se penden unt a vote was taken on that propo- jon. Mr. Townshend objected, and insisted that the previous question should be executed. The Speaker intimated an unwillingness to.decide whether Mr. McLane’s motion was of such high privilege as to taxe precedence of the previous question, but submitted the question to the decision of the House itself. Mr. Knott remarked that it was a subject which required consideration, and moved to ad- journ. ‘The motion was rejected—yeas #1, nays The Speaker then stated the question to be as to whether Mr. McLane’s proposition pre- sented a question of as ilege. The proposition Was drawn up 80 as to discharge the committee on the revision of the laws from further consid- eration of the bill, and refer it toa committeeon ways and means. The vote on the question resulted yeas 105, nays 22, and the point of no quorum was raised ‘on the democratic side. Mr. Atkins moved to adjourn. MaRRIED Woman's Ricuts.—In the Supreme Court yesterday, in the case of Mrs. Mary R. Day, against iced & Saffell, action on open account for $600, Judge Gilmor decided that a married woman must make an aftidavit to the facts in all suits. The suit was brought to the March “rule day” and an affidavit was annexed to the declaration, in order to compel the de- fendants to plead under oath, or be compelled to submit to judgment within thirty days. When the case Was called it appeared that the affidavit was made by the husband of Mrs. Day, the plaintiff in the case, and Mr. B. Howard Haman, counsel for defendants, moved to strike out the affidavit from the records,on thegrounds that it ocgay to have been made by the wife, who was the substantial plaintiff. Colonel H. D. Loney, counsel for the plaintiff, opposed the motion, but the court decided that the motion was proper and ordered the affidavit to be stricken from the records, saying that a married woman was as competent to make an affidavit as any one else and that_her husband could not swear for her.—Balt.
