O'Donnell et al., was referred to the auditor to state account. "This cave had been on argument for three days, Mr. J. Webb Rogers for plaintiff and Judge Ray and Messrs, Riley and Newman for the defend- apts. The court decided that the plaintiff should pay (as prayed in the bill) only the money which was due on his property when it was placed in the building association by his brother, without the fines. dues and advances claimed by defendants; and that defendant, Wm. Bassett, beaded by Weber's full brass band, and escorted by the Alexandria Light In- faptry, entered the grounds, bringing with them a large crowd to swell the vast throng already present. IN THE ADMIRALTY C in the U.S. District Court in Alexandria, Va., Judge Hughes, of Joshua Ellis ee the tug boat Katie Wise, a de- cision rendered that the tug boat Katle Wise, belonging to Capt. John . Graham, is respons!- ble for the collision by which the schooner Martha Washington was Injured, and that the libellant, Capt. Ellis, is entitled to damages. ‘The case was referred to a commission to take testimony. Scrt AGAINst A Horer.—Edward C. Wada, a member of the Washington Bicycle Club, yes- terday entered sult against John B. Scott, of the New York Avenue Hotel, for $5,000, which he claims because when on the 27th of Septem- ber he entered the dining-room where other persons were seated and eating, and requested to be waited upon, the proprietor refused to fur- nish him with food, and ordered him to leave the room. On the 27th instant Mr. Wade, after paving exercised on his machine, appeared in the dining room in the club uniform and took his accustomed seat at the table. The uniform consists of a blue flannel shirt, gray knee breeches. gray stockings and high shoes. The Proprietor objected to having a guest appear at ‘he table In such toggery, and declined to fur- nish the hungry bicyclist with a dinner. Shorter, by cutting him with a knife, was resumed, and was given to the jury. ‘The defence was that Shorter ha’ been keeping com) with Bowen’s wife and hav- ing had a difficulty with her, Bowen went to find Shorter to ask him about tt, and heclaimed that he used no knife until Shorter struck him With a stick, and he then inflicted the wounds. Gibson, a re- spectable looking white man was arraigned on the charge of stealing $15 from Mr. George W. ‘Wilt, a lame man, who testified to going with Gibson to the bath rooms, and while taking a bath this man abstracted the money from a box in lis room where he placed it. OMicer Mocka bee, who was called in to make the arrest, testi- fed that Mr, Wilt chargea (iloson wi th obtatn- ing the key to the box out of his (Wilt cket and abstracting the money. He had given him four silver quarters for showing the way to the bath. Gibson had no testimony to offer, and the court. sentenced him to sixty days in jail. An appeal was taken. A VITRIOL THROWING CasE.—This morning, in the Police Court, Hannah Jenefer, colored, was charged with an assault on Martha Ball, a rather good looking yellow woman, On the 30th day of May last, when she was arrested by Officer Farquhar, The case has been con- tinued from time to time on consequence of the sickness of defendant. The testimony of com plaining witness was that, as she wason her ‘way home from a pic-nic the prisoner walked up beside her and dashed vitriol on her dress burning it. Mr. Birney, jr., appeared for the defence and submitted that the fact that the vitriol was not thrown upon the person showed that there was not a serlous offence contem- plated. The court imposed a fine of $20 or 30 day: A Divorce Cask DisMisskD.—To-day, in the Equity Court, Judge MacArthur dismissed the divorce case of Mary A. Orme agt. Thos. P. Orme for irregularity. The parties were mar- ried in 1868 and lived together until 1si4, when she was forced to leave him by reason of his dissipated habits. ‘THE NEW GATEWAY AT ARLINGTON CEMETERY is about completed, but there was a mishap there before the work was finished. The gatec- way is composed of the columns, etc., of the north portico of the old War department butld- ing, recently torn down. The columns were about 40 feet in height. When the cap being put_on top of them no dowels or clamps were used, and the stone work fell, breaking the scaffold into pieces, The workmen miracii- lously escaped. When the work was resumed there was plenty of iron used to make It all secure as it progressed. AN EX-WASHINGTONIAN KILLED BY A Fall. FROM A TRAIN.—An Omaha paper of September ‘25th states that train No. 7, which left that city at 6:10 the previous evening, was in charge of Conductor Charles Mockbee. Among the other train employes was his brother Frank, a young Man 23 or 24 years of age, who was acting in the capacity of brakeman. 7 1s due at Jackson station about 3 o'clock a. m., and on its arrival there on the morning of the 25th the young man was missing. The train was immediately backed up, and three or four miles east of the station were found the remains of the missing brakeman. It is not known how the accident occurred, but it is probable that as the trata was approaching the station young Mockbee went ‘on top” .to attend to his duty. That either in climbing up or passing over the top of the cars his foot slipped In the darkness of the night he was unable to recover himself, but fe. beneath the train and met his death there. The two young men above mentioned were residents of Washington, and brothers of Mr. Thomas Mockbee, who carries on the shoe bu ness at the corner of 12th and F streets. He h a letter from Charles stating that Frank's nec! was broken, but the body was not mangled. The deceased, Frank Mockbee, was formerly in Mir. Hazleton’s shoe store, on 7th street, and went west last August. ‘TROUBLE A GT ASPHALT PAVEMENT CoxTRACTORS.—To-day Gen. Butler and Mr. 0. D. Barrett filed a bill for Oscar J. Ave against Walter R. Davis, for a dissolution partnershtp, appointment of receiver and to enjoin defendant from interfe! with the business or disturbing the assets. ‘The bill sets forth a partnership in May, 1s77, for the pur- se of laying pavements in the District, and jaltimore, Md.; that at that time plaintiff held by contract with the Grahamite and Trinidad Se company, of New York, the exclusive right to lay such pavement in the District and Baltimore for five years; also the right to use certain secret processes held and owned by said paving company, and the right to use the ma- chinery, fixtures, tools, &c., at the corner of B and 15th streets, &c.; also the right to be fur- pished with asphalt by said company at 5 pe: cent. above its cost, and all these rights were transferred to the partnersnip: that no capital Was put into the concern by defendant. He states that during the first year they laid pave- ments amounting to $103,500, and since this amount has been increased’ to $130,575.30; that defendant has rendered no account to him, and the G. & T. A. P. Co. has called for an account. but defendant has refused to recognize its Tights. He charges there is due to him $5,739.63 as his share of the profits, and to the Graham. ite and Trinidad company $8,977.33. And de- fendant has redu his possession all the money due for work done except $12,489, as necessary for keeping the work in repair. He therefore prays as above. The defendant, W. R. Davis, was last night put out of possession of the works in question at the corner of 15% and B streets, leased from Messrs. Middleton Wilson, who have an $11,000 mortgage on from Gen. Averill, who has executed a lease to Messrs.
