This motion was argued at length by the coun- sel. The court overruled the motion, and dl- rected an order to be drawn for summoning the witnesses beyond the jurisdiction of the court— the district attorney saying that there would be no difficulty as to the payment of witnesses who were summoned to prove the character of the prosecuting witness prior to this occur- rence. THE MUTUAL FIRE INSURANCE COMPANY'S Casx.—On Saturday, Judge MacArthur, in the Equity Court, resumed the hearing of the case of Richards et al. agt. the Mutual Insurance ( Vp which the papers were read on Friday— essts. Merrick and Morris for plaintiffs, and Messrs. Davidge and Lambert for defendants. On the opening of the court Mr. Davidge sald he had pre} a form of decree to carry out the suggestions of the court. Mr. Merrick said he did not know that he had any objection to some such ee if it could be done in accordance with . They did not propose that the property should be tted up, but that a receiver take charge until this 1s settled. Mr. Morris for complainants opened the argument on the point as to the validity of the election, claiming that it.was a regular election under the by-laws of the company. Mr. Lambert and Mr. Davidge argued th case on the Pps of the respondents, claimin that they had full power, when advised, to cal a new election; that they had made arrange- ments for holding such election, and would abide the result; and they contended that the answer refuted the allegations of the billon every material point. Mr. Merrick made the closing argument for the foe gener and Judge MacArthur compiiment the company and decided that the jurisdiction of the chan- celior was of right to be invoked by any bene- ficiary to compel the proper discharge of a trust, and the managers of a company were but trustees for the shareholders. He would restrain the election now announced to be held, but would not turn over the affairs of the com- pany toareceiver. He would proceed no fur- ther now, leaving the complainants, the new board, to test, by quo warranto or mandamus, the title of the old board to the control of the company.
