S. Edwards secretary. Mr. Edwards gatained that the case of the com- pany would tg he heard in court to-day. and. g the bill, he explained the provisions of it. Mr. Shiles thought that the use of the word “receiver” in the ‘was unfortunate, and that the other side were use of it and preju dicing stockholders. Mr. Frasier sald the other side were representing the object to be the ap- pointment of a receiver at $10,000 per acne and they were circulating a paper as a petition to the court based on such statement. A dis- cussion followed, in which it was claimed that there may be no necessity for the appointment of areceiver. Such an officer would be neces- sary if the decision is against the legality of the new board, and should a receiver be appointed it was probable that one would be found who would not accept pay. Mr. J.J Edson offered Tesolutions: which were unanimously adopted, “that we condemn the course of the old board of managers In distributing circulars and pett- tens that they know to be false for the purpose of misleading the policy-holders in order to in supporters; that the application in the bill fora temporary officer, to be appointed by the court, acceptable to all parties, to serve without compensation, to take charge of the books, records, assets, &¢., of the company until the dispute is settied, which will probably require three or four weeks, is approved.” Adjourned Saturday night. tO STR CASE IN THE EQUITY COURT 70-DAY. ‘This morning the case of Richards et al. agt. the Mutual Fire Insurance Com} 7» Wascalied in the Equity Court, Judge MacArthur. Mr. Morris stated that Mr. Merrick was absent fo New York, and could not be here until to-night. He would, therefore, ask a continuance until to-morrow. Mr. Lambert suggested that in view of the short time before the elestior, which is sought to be restrained, there siiou'd be no unn delay. Mr. Davidge said ordinarily he would have no objection, but in this case he thought the defendant was entitied toa speedy hearing. He referred tothe pecr- Nar circumstances of this case, and noted the proceedings, stating that by a mistake they (the defendants) had called an election, not giving the required time, and acting on the}; advice of their counsel they had called a new election to be held on Monday next, giving more than a month’s notice, ad- Yertising it on the 5th of March, with a resolu- tion declaring their decision. The bill was not filed until Saturday last. The election ts called for Monday and all preparations had been made to hold such election, and he asked therefore that there be no delay. This bill was filed late on Saturday and as yet they had not been fur- ished with a copy of the bill. Mr. Morris said that he Ln d @ member of the company was not of counsel, but he drew the bill as the agent of Mr. Merrick, After some§ further discus- sion the court said he would hear the papers Tead and ad} until to-morrow morning at 10 o'clock. Mr. Morris read the bill, a synopsis of which has been published in THE Star, and the charter and by-laws and referred to the ex- hibits as to the elections, xe, In answer to the court Mr. Morris said that the complainants did not make a point on the sufficiency of the notice for the meeting of January 10th, and claimed that the managers had called tals meeting and the election was legal. THE COURT SAID, without any intention of forestalling the argu- ment, he would submit that nothing could be more éisastrous to a solvent corporation than entering into litigation. He would do what he could to relieve this institution from such a fate. It would appear that heretofore this in- stitution has the confidence of the commu- nity, and tt is quite evident that if it 1s possible to remove an obstacle at the outset it ought to be removed. INTERESTING Casg.—The corporation court has been engaged for the past two days in the trial of the case of J. W. Brooks vs. W. C. Har- vey. The case grows out of an over-payment of Harvey to Brooks for a load of oysters, in ington. Brooks was arrested here, on his ay down the river, on the charge of stealing the money, and was committed to jail by Jus- lice Padgett. He was afterwards brought be- fore Judge Lowe on a writ of habeas corpus and releasen ou the ground of some faformulity in the papers. He now brings sult agatast Har- vey for malicious prosecution, false iiprison- ment and slander. Messrs. Edmund Burke and A. W. Chilton represented the plaintiff, and Messrs. 8. G. Brent, K. Kemper, of this city, and Carrington, of Washington, the defendant. The case was given to the jury last eventing, and after waiting until 10 o'clock last. night the court adjourned them over until this morainz. Ata late hour this evening the jury was still out. Gib- son and French, After a careful examination, Mr. Pierpoint was adjudged a lunatic and the application for his admission was forwarded to the Western Lunatic Asylum at Stauaton, to- day.
