Mr. W. A. Cook followed for the defense, and argued that the grand jury Is clearly il- legal. He had not concluded when the court adjourned until this morning. TO-DAY. This morning, the court-room was crowded to overiiowing, and after the prisoners had been brought in and the court had been con- | vened, Mr. Cook resumed his argument on the pleas in abatement for the accused. He argued that under the rev.sed statutes noth- ing is left diseretionary with the District Commissioners, but the statute in manda- tory a to the duties of the clerk and the marshal. Judge MacArthur said that he did not see any wrong had been doue by the manner of drawing. Mr. Cook said the wrong was that the ex Riess pros isions had not been complicd with ne grend fury had not been drawa more than ten days before the term, and the names or half a dozen persons bad’ been placed in the Jury box within two years after prior ser- vice. Mr. Merrick commenced bis argument claiming that while he did not depreciate the other pleas he looked at that which leges that names were placed in the jury box within two years after previous service as the most important, and he read from the record that Sheriff, Darnielle, Lamb, and Jones were such jurors, and be noticed that the records do not sbow that Darnielle was excused, and during hissickness W.
