Monday, Tuesda, The Rights of Citizens and of Rail- roads. The opinion of Mr. A. G. Riddle in regard to the rights of citizens and the duties of rail- road corporations, read at the meeting of property holders in South Washington last night, would seem to be in accordance with both law and equity. The conclusions reached in this opinion are: First, that whoever buys or leases a house on a strect in this city ac- quires a property in the street to an extent necessary for a full enjoyment of the house. ‘That there is no power in the municipal cor- poration or national goverament to violate this right of property or to authorize others todo it. That if a franchise is granted toa railroad company, for instance, to lay down ® track and run cars along the street, it must be done in such a manner as not ma- terially to impair this right of the residents. Second. If the railroad company so con- structs its track as to materially obstract the strect, each resident may maintain a suit against it fordamages. If ft permits its cars tostand on the street, or muitiplies its tracks, or attempts to make any use of the Street for freight or other purposes In any way, except to pass the tra: arefully along the same, a right of action accrues to tue in- Jured resident for each of thes: acts. If the trains are moved with such rapidity as to produce a shaking or vibration of the ground, thereby occasioning injury to the walls of buildings, the owner may have his action. In conclusion, Mr. Riddle holds that a rail- road company has no right to torture the sick and infirm with noises which can with care be prevented. ——+ee-—__ — The Hawaiian treaty was ratified by the Senate in executive session yestenlay by a vote of yeas 51,nays 12. Ithad been amended by striking out the word “fruit” from the list o§ Hawaiian products to be almitted free of duty, and merely substituting “ ba- nanas,” the object being to protect oranges and other semi-tropical fruits of California, and the committee amendments were agresd to, adding tobacco, leather and all manufac- tures of leather to the list of American pro- ducts to be admitted into Hawaii duty free, and also the amendment providing that du- ring the pendency of the treaty the Hawaliam government shall not cede or lease any port, bay or naval station to any foreign gov- ernment except that of the United States. The main thing gained for the Unite. States by the treaty is a naval station in the Pa- cific. We shall also be in a position to exer- cise alittle paternal or fraternal care over the Hawaiian kingdom in case any Euro- pean ration should lay an avaricious paw upon it. ——~+e —___ Nodoubt Senator Hamlin can explain how he came to offer that amendment in the last hours of the session increasing the postage on transient papers. There seems to be a great deal of talk about the matter, and per- haps he'd better. Mr. Samuel L. Phillips, president of the ‘Third Avenue ratiroad, in New York, is try- ing to retrieve the fallen fortuyes of that road, and has just made reductions in the salaries of employes, aggregating, it is esti- mated, £10.000 per year. In making these re- duetions Mr. Phillips did not forget to cut his own salary down one-third. ———_-~<ee--___ At the last meeting of the New York ¢ city board of education a communication was re- ceived and referred to a special committee from Vicar-General Quinn and others repre- senting the Roman Catholic parochial schools, requesting the boari to appoint a committee to confer with a committee rep- resenting the parochial schools, ‘to consider on what terms the said parochia! schools may be admitted to the benefit of the com- mon school system, subject to its laws as regards course of instruction, the methods of discipline and the general management in such manner as may be agreei upon.” The Viear-general states that there are 30,000 ¢hildren attending parochial schools, and | that upon the right intelligeuce of the people depends ina great} measure the safety and | happiness, and, indeed, the prosperity of the | country, and that, claiming to have these objects in view, they desire to find a com- mon ground of action that wil! be mutually agreeable and beneficial. — The fall vote of New “Hampshire at the late election is now ascertained to have been 79,202, of which Cheney, the republican can- @idate for governor, received 5: and Rob- erts, democrat, 39,163, the prohibi tess than i @ gain in favor of the latter ‘The Congressional vote this year fell but 500 behind th for governor.
