His testimony was to the effect that in April, 1572, he was indicted for the alleged selling ef liquor on which the tex had not been paid, although he was innocent of the charge. He paid several sums of money to have the case dismissed. Hearing of the indict- ment he went tothe court and gave bail. A Goodrich Fay soon came to him \d said he could bave the case dismissed by the payment of $2,000, which money was to be divided between Fay and Sanborn. He also paid $1,000 to Jad, Davis, at that time district attorney. He said be paid the $2,000 demanded to rid of the al, although he was entirely innocent of the charge.
