The recent decisions of Judge Hamphreys, | ruling as equity judge, appears to be contrary to the precedents in similar cases as decided heretofore by the Circuit Court, by Auditors Redin and Cox, the Supreme Court of this Dia- trict, and the United States Supreme Court. ‘The learned Judge may sustain his ruling, but at present the “legal mind” of the Washington bar has been taken by surprise, as, indeed, have been the building associations. One or two lawyers of repute have, indeed, shaken their beads ominously, and said the Judge has pro- mm ted “good la The building associa- tion question has been announced once or twice from the bench as‘‘a muddle, nd both judges and lawyers seem somewhat tohave made a merit of their obfuscation on the sub- ject of their practical working, or finan- cal system. This foggy condition has been much increased by the practice of those lawyers who clients have been defendants in building association suits. Their custom has been to describe building associations as finan. Auditor Walter S. Cox, in his report in the Hatter case, July 15, i869, sums up the conditions under which | building associations operate, as follows : Upon the general question, how far the taint of usury attects tho operations of these building associations, there was much discussion in the late circuit court of this District, and one or es e decisions. It may now be regarded assettled law, I think, that the principle of these societies ts not at all in contlict with the usury laws. The theory is, that the members make monthly con- tributions proportioned to the amount of stock subscribed by them, which are to be invested, Te-invested, and compounded, until a certain amount can be divided toeach share. Bat in order to realize the benefit of the assogiation immediately, the members are willing to dis- count these futuredividends, to receive them now at their present value. This value ts as- , certained by exposing them to compotition. When the amount of one or more shares are | received from the monthly contributions, it is | offered allow the largest discount, o-, as it is called, the highest premium, gets it.’ Itis, in short, mere sdvance to ‘tner of hisshare in the partnership assets. When the advance is made, | the partner continues to pay his monthly con- | tributions, and, in faet, doubles them where he bnys the whole amount to which he is entitled. | He is also bound to pay a stipulated tine for | every defanit in the payment of his dues. This | subject was examined at considerable length | by W. Kedin, the late auditor of the court, in @ case in the late cireuit court, Sweeny Dowling heirs, 1069 equity. He, however, rejected the fines The bill was filed in that case by the he Northern Liberties Building They sought the active aid of the court to enforce their claim, which consisted in part of penalties, and the auditor rejected the fines upon the general ground of the unwilling- ness of the court to enforce penalties. I believe his views were sustained hy the court. In another care, John Johnson vs. Trustses Pots mac Building Association, the debtor was com- | Piainant, and filed his bill’ to enjoin the sale of the property mortgaged to secure the payment | of hisdues. The same questionof usury was reviewed and decided by the court in favor of the association, and they further refused to | interfere to protect him from the collection of | the fines by asale, on the ground that there ap- peared nothing oppressive in the fines, aud equity would, in such case, leave the complain- ant to his legal rights and remedies. The fices | or penalty, in fact, is merely an additional sam which the debtor ts to pay incase of defaultin ibe payment of his dues. The Supreme Court | of the United States decided this to be not | usurious. The present is the identical case of & debtor endeavoring to prevent the entorce- ment of his deed of trast, aud is within the ruling referred to. ‘This is a very clear and concise statement of the ease, and the auditor's report, from which the above isan extract, wason the very nextday, July 16, 169, “duly ratitied and contrmed” by Judge Oun, justice of the Supreme Court of the District of Columbia, sitting tn baukruptcy. Building associations are sometimes alleged to be holders and disbursers of the capital of the wealthy. The facts are precisely the reverse. ‘The funds of a building association are the con- tributions, and often the only savings, of those who have no bank accounts, of the laboring man, the stipendiary clerk, of business men with small capital, and of | women aud minors, who are thus induced | to set aside from one to twenty dollars per | month in order to provide for “‘a rainy day,” or to obtain small homesteads that they can pay for by advancing each month @ small percent- age beyond the howse-rsnt which otherwise would be “7 posited, never to return, in the keckets of a landlord. As the contributions are | voluntary and recoverable with interest at thirty days’ notice,so the purchases, confined exclusively to members, are likewise voluntary, and are made under printed regulations, which each member has ample time to study. It is true that, a& the funds are sold at auction, a purchaser may, in the excitement and rivalry of bidding, oyerstep the bounds of prudence and make rash and expensive purchases. But is he not liable | to the same blunder in any other purchase? Suppoee a bidder at our city horse bazaar gives @ hundred doilars for a horse not worth fifty; is | the auctioneer to be cited before the | courts fer a violation of law or equity? ‘The purebaser of money ina building associ- ation has this advantage over the bidder on horsetiesh or other property, he is not obliged to take his purchase on the terms he has, it may be hastily, agreed to; he can decline his pur- chase altogether, but he is charged with one month's interest or premium. if Judge Hum- | phreys’ decision is sustained in the higher courts, the effect will be to unsettle the affairs of about twenty-tive build trict, comprising a membership of several thou- sand persons, and a‘lecting the status of money | and property to the amount of more than a million of dollars. Thas it will be seen that the large | interests at stake are likely to be maintained by @ thorough canvass of the whole question, and | & prompt resort te the appellate courts. | Althoeg4 unfortunate or fraudulently delin- | quent purchasers of money from building asso- ciations sometimes subject their property | to the auctioncer’s hammer, yet it is a fact, well-es: hed, that they contribute to the prosperity of a city in various ways.
