Orders, accem- panied by the money, should beseat to the bust- ees office of the paper. presen er ‘That there have been repeated and gross vio- lations of law by some few of the magistrates and constables of this city there is no doubt; the sufferers by the petty exactions and illegal seizures of these licensed harptes being mainly those who are ignorant of their rights, or know- ing the law are too poor to bring their perseca- tors to the bar of justice for their cruel extor- tions. Admitting these facts, it ¢s not just to assert (as some do) that our magistrates may be divided into two classes—the knaves and the fools. The majority of them are men of in- tegrity and intelligence. Bat less serupalous and more ignorant magistrates do a large por- tion of the business, some relentless creditors preferring them in the same way that they pre- fer a constable without a conscience to collect the judgment when rendered. The Congres- sional exemption law, published in Tae Star a few days since, is violated every day, because the poor no suffer from its violation find that it costs more in the long run to obtain Justice than submit to the exaction. To illustrate A has a judgment against B for a debt, and he gives it to a constable who takes out execution, and finding no property of B's to levy upon but exempted property takes some articles which by the law are exempted. The only remedy ef B is to sue out a writ of replevin which he pro- ceeds to do, having to give bond to the District of Columbia to return the goods replevied if judgment is given against him, and he has to | pay about ten dollars costs to obtain the writ ‘Then it is tried before a magistrate and as the constable is defended by lawyer, it is neces- sary that the plaintiit, B, shall alsoemploy a lawyer at an additional expense of five or ten dollars; then the constable has as many. post- ponements af the case as car be had for the purpose of tiring the plaintitf, who if a working man must lose twoor three days. If | judgment is rendered in favor of B the consta- ble appeals to the Cirenit Court, and from three months to a year must elapse before the | trial comes off there, a lawyer being necessary eople &. Unfortunately the applicaticns made to bim for his Professional serv: came #0 numerons and so profitable that he gradu- ally negtected his duties in the “Mutual Life,” al- lowed the Actuarial Department to become mach confused and in arrears, and firally furnished work- ing formule for computing divideads, which were #0 questionable as to lead to their reference to such distinguished tlemen as Professor W. H. C. Bartlett,(then of West Point, now Actuary of the company ,) Professor Church,and Professor Peirce (of the U. 8. Coast Survey), whose patient and in- borious investigation, and very able report, failed to sustain Mr. Homans, and caused serious changes to be made in his formule. The soreness and in- subordination exhibited by Mr. Homans after this, together with @ continuance of the negleet of oa referred to above, led the Trustess to discharg him, That part of his card which leads the pubtic to believe that he left in a fit of virtuous indigna- tion is sheer nonsense: he left the company becanse the Trnstees discharged him,and the Trustees dis- charged him because he neglected his duty.
