Carrolj, = col- cored overseer. The fact that § post mortem ex- amination was made over the body of the de- ceased was also made known, as well as that Dr. WW. Potter, coroner, bad caused to be summoned 8 jury of inquest to investigate the licited corroborated the statements made in our iast issue, and shows further that atthe time the fatal shot was fired the parvies ‘Were within fifteen feet of each otner. fe was further im evidence that while the parties were runpmg Carroll called out to the head gardener, (Smsn Damed Atkins,) “Shall 1 give it to him!" Atkins replied, “Yes,” amd then the second shot was fired. A statement made by Carroll Was to the effect that Catlett tried to run. he called to him to stop, when the deceased threw 3 piece of marble at him: after which be pur- sued bim and shot bim. The jury, after near- ing all the evidence, rendered a verdict that the deceased, Richard Catlett, came to his death from & wound in the right lung, produced by 8 bail from & pistol fired by the Land of William Augustus Carroll. Burbridge. who was arrested yesterday after- noon by Deputy Marshal Phillips, as siated in the STAR of yesterday, on an indictment found by the Grand Jury of the United States Court ofthe Eastern District of Missouri, charging Bim with conspiring to defraud the Govera- ment. Bad a hearing before Judce Wylie at 34 -m.. Messrs. Walter D. Davidge and Judge Pennybacker, of Rentus Ky. appearing as bis counsel. In answer to a question from Judge Wylie, Gen. Burbridge stated that be was a ni- uve of Kentucky, Bad not been in Missouri for & year, and then only remained eight days. Lewis. Action to recover the amount of S400 and interest due on a promissory note made by one Pitcher, and endorsed first by the defendant and then by the plaintiff. which had been paid by the plaintiff. A plea ot usury was filed by defendant. Norris for plaintiff: Mat- Ungiy tor defendant. C. Lewis,and piaced in the hands of the plaintiff, with a view toefiec' a sale of the said note, and realize the proceeds for said Pitcher, endorsed the same and ob- tained the proceeds at a deduction of onr-half of one cent per month from the free of the note and paid the same to the said Pitchsr, the plaintiff is cptitied to recover, althougn they sbould further find tbat the interest earried on the face of the paper, with said deduction. would amount to more than legal interest, un- less they should further find that the said note in its inception was usurious.
