St. Joseph's Suciety, of this city, having the erection of the churea 19 ebarge, have been making preparations for the ceremony for several weeks past, and invita- ions were extended to various German Uatho- lic in the neighboring cities to partici- Pate in the ceremonies, as it 1s designed that ‘he church shall be erected by the German @athohes throughout the country. Many in- witations were responded to, and delegations ‘were present from various portions of the country. The largest delegation was trom Bal- more, being composed of members of the various German Catholic societies of that city. CHARGE OF NRGLEUT OF DUTY AND EMBSZZL8- ‘MENT. The case of George H. Moore, commenced before U.S. Commissioner Edmund F. Brown on the 10th instant, when it was postpones, Was again called this morning. The accused is the Deputy Collector of Internal Revenue for the Third Collection District of Norta Car- olina, aud is charged with wilfully neglecting the duties of bis effice, and with embezaling Various sums of money, amounting to $1,000 collected by him at various times. Messrs. Coo and Burgess appear for the accused, and Messrs. N. Wilson, Assistant District Ato! and E. L. Dana, of the Internal Revenue B reau, for the prosecution. The first witness called was James Johnson, Who testified that he has been a residen: of White Hatl, Bladen county, North Carolin: for thirteen years: knows the defeudaa: by by sight, and identified him: witness was in the spirit barrel business at White Hall; fre- quently saw Mr. Moore in 1566 and in the sum- mer of '66; sometimes for paying his taxes; paid him money as Deputy Collector. (Witness ex- hibited three ré for money so paid.) Two Of these he paid to Mr. Moore in person. W. S. Petersom sworn.—Witness resides in Sampson county, North Oarolina, and is a farmer and distiller: krows Mr. Moore, thiaks he paid bim money in 1565 as also in ‘67 as Deputy Collector. Mrs. Mason, is a most respectable and excellent lady, and formerly resided iu this place, where she has many friends. We learn from the Port Tobace we that the roboers, two black men, named Day and Butler, have been arrested. ‘As soon as information of the nstable T. B. Delozier party, started in pursuit and succeeded in arresting Day on Monday mght in a negro cabin near the “frappe,” in the lower section of the district. The gun was found in the cabin, and the warch and about $6 in money pon the person of Day. Later, on the same night, Butler was also arrested. Both are now in jail. The defence set up by the company was am these word! “First_That the proof furnished omitted to state truly the cause of tae death of said Mar- cus. cues the said a — commitied suicide, i ing an wounding himself, wie this dnaica and foe = pu of producing death, of whic i tnd wounding suid ous died.” The company aiso attempted to prove that Gibson was an atheist or infidel, and therefore that the suicide was intentional. the deceased not baving the fear ot God before him; but the courtruled out this as irrelevant, aud held that in anaction to recover for an insurance upon the life of the deceased, it is incompetent to inquire into his religious faith with a view of influencing the question whether, in such case, death was occasioned by an intent of self- dettraction or of aceident. The court of Appeals therefore a‘firmed the judgment of the lower court by giving judg- ment for the respondent, thus virtually @stab- hshing the principle thata Itfe insurance pol- icy is not of necessity invalidated by the suicide of the insured person: or, im other words, that though a mam should be suspected of having committed suicide, his widow and children are not therefore to be deprived of the amount of his life insurancef whether he was Christian or heathen.—N, ¥. James Hinds, member of Congress from the second district, was assassinated Fridav, while traveling through Monroe. Hon. Jos. K. Brooks, who was traveling with Mr. Hinds, Was wounded, but itis supposed not fatall: James Coolsey, an ont spoken republican, wa murdered in the same county. near Clarendon, a few days since.
