O’Beirne as jater- reter.— Witness resided in West Shefford, in Jenada. Had resided there seven years. Kaew Dr. McMillan. Had resided eight miles from him, at Front Village. Witness knew where the village of Waterloo was. Dr. McMillan resided there; he lived there in 1944. Witness knew many persons in Canada who were ac- quainted with Dr. McMillan. Had ‘heard them speak of him very little.” Knew his general reputation fer truth and veracity. Had beard persons speak of the character of Dr. McMillan many times. All the people who employed him as doctor said they would not employ him again. His character for truth was very bad. From what people say of Metin, witness would not believe him on oath. Croes-examined by Mr. Pierrepoint:—Wit- Dess was & farmer. Knew @ priest named Bushea, the same about whom McMillan spoke in bis testimony. Witness never was in the employ of Bushea. Never was a ser- vant forhim. Had been spoken to about this case by Mr. Nagle and Mr. Bushea. Witness did not know Charles S. Martin, of Waterloo Witness bad been epoken to by Mr. Bushea about McMillan. He said nothing against Dr. McMillan. Witness never said in presence of Charles S. Martin that he would do McMillan what damage he could. Was not an enemy or hostile to Dr. McMillan. Had no reason to be his enemy. In 1964 witness was employed in cultivating land. Never was in the service of Mr. Bushea. Had lived in the house with him in 1964. Bearded with him for three months. Sometimes worked for Mr. Bushea to pay for hisboard. Witness at that time cultivated a farm. Left the house of Mr. Bushea in An- guet, and returned there in the month of Jan- uary. Remained there two months and a half. ‘nis morning in the Criminal Court before Judge Fisher. and the testimony for defense continued. As usualthe room was crowded long before the opening of the Court,and many ‘were unable to obtain admission. The jurors and prisoner having been broughtin, the Coury ‘was opened, and— Rev. Father L. Rocoffort sworn and examined by Mr. Merrick.—Witness knew Lewis J. Weichman. Had a conversation with him out- side of the confessional. Q.—Did he ever tell you that he was em- ployed in an office here under the Government «nd turnished information to the South. Objected to by Mr, Carrington. Mr. Merrick read from the testimony of ‘Weichman where he had testified that he never ad a conversation with Father Rocoffort ex- wept at his feet in the tribunal of penance, and nevertold Mr. Rocoffort that he wasemployed ym an office, and furnished information to the South. Mr. Carrington argued that the witness Weichman could not be contradicted. They charged Weichmam with being an accompliee and should prove it by facts, not by asking ‘Weichman a collateral question and contradict him by another witness. The defense was bound by his answer. Mr. Merrick said Weichman was in tha’ conspiracy, and was an accemplice. which the defence bad a right to prove. He proposed to show that Weiehman held an office here for the purpose of receiving information and far- ishing the same to the Confederate Gover! Ment; and as an officer of the United States ‘did recetve such formation and transmit it to the Confederate Government. The defense had a right to show the sympathies of the witness Weichman, and what his associations were. The Conrt had allowed the prosecution to put questions to show the sympathies of witnes-es. and certainly the defense Rad the same right. Judge Fisher said putting questions to a witness to show his temper and sympathies ‘Was one thing, and examining anocher wit- ness asto the same was another. Jr.—Witess resided in Montreal, | DECREES oF Divorce —Yesterday, Justice Carter sitting in the Equity Court, made a decree divorcing Elizabeth Strebd from the tonds of matrimony with Louis Streb, giving her the guardianship of the children. The petition filed June 8th, sets forth that the par- ties were married in June, 1663; that they have two children; that the respondent deserted her on the 25th of March, 1667, and that he was guilty of adultery on the 15th of May of that year. M. Thompson appeared for the petition- er, and the testtmony was taken before Com- missioner E. F. Brown. A decree was also granted this mornirg di- vorcing Louisa Harcy from the bonds of mat- rlmony with Henry J. Hardy, giving the pe- titioner the guardianship of the children. ‘The petition in this case was filed onthe 15th of April las', and sets forth that the parties ‘were married October 16, 1361; that they had two children: that the respondent has ill- treated her and threatened her life, &c., ahd also charges adultery to have been commitied , but did not | by him. | Im this case the testimony was taken before Commissioner E. F. Brown, and some of it, that ot a witness named Williamson, had been taken in Richmond before the subprrna to an- wer had been servedion the respondent,hence an order was made ruling out all the testi- mony. Yesterday Mr. M. Thompson made s motion to set aside this order, and claimed that the testimony, exceptthat of Williamson, had been properly taken: that his testimony was taken inadvertently. The Court asked fora reading of the eyi- dence, aud that portion taken after the process was read, when the Court remarked that upon & proper record being made up the Court would grant the decree as prayed. The testimony of one witness was to the effect that he nad seen bim in a house ot pros- litution on 11th street, where he sung 8 black- gusrd song, and afterwards saw bim at Madam Wolf's. Another witness testified to the ill- treatment of bis wife by him, and to his hay- ing told witness apout a little black-eyed gir. The mother of the petioner, Mrs. Maria Hilton, testified to the bad treatment received by her daughter at the hands of the respond- ent, and to bis having told the latter that he ‘would go to a house of j!] fame.
