E. CLeaver on OHARGE oF Tus Mvxp oe Mary ANN REBVES—Crim- anal Court, Judge Fisher —The court met this Morsing at baif-past nive o'clock, when the esse of Wm. E. Cleaver, indicted for ine mur- der of Mary Ann Reeves, was resumed. and he argument before the jury commenced. Dictrict Attorney Carrmgton opened the ar- gument. After reviewing the evidence in the ease, Mr. ©. contended ti at least the ac- cused was guilty of mans ghter. If wap- pears from the evidence that the prisoner at the bar violated the person of this girl with- out her consent, and it resulted in her death, shen he ts guilty of murder. Assume that she went there ofowm consent; assume that she accepted the two dollars from him: assime hatsbe was common strumpet, the lawsays ithe forced her, he committed the crime of rape. aud ifthis resulted im her death, he is guilty of murder The only question, then, gentlemen, open tor your consideration is, did be use force or mot’ andif there is faith im buman testimony { will show you that he did use force. and is guilty of murder. Mr.©. again referred to the testimony to show that the accused was guilty of rape, which resalted in death it ‘Was true that the defense atterapted to contra- dict the witness, Mary Ano Brown, by Justice Walter—and ere, gentlemen, it may be "te tor me to refer to this modern Dogberry—this bright and shining light in the jadicial firma- meat. Why, old Dogberry is not a circam- stance to Justice Walter. A man is arraigned before Justice Walter tor rape, and he did not think it was necessary toask if the accused had used force In referring to the evidence of Justice Wal- er, Mr. C. said the justice had testified he did not take rotes of the imony before him, and he attempted to testify before this court from emory. Why, gentlemen, here is a Dutch udee with Mr. Norris, Mr. Fendall, Major Richards—who, I never read a law Book 1m bis life—a joyd, who is a very able iawyer. Now, gentlemen, 1 submit tnat tor avy tan, with these four lawyers fussing and bamboozling him, it is utterly impossibie for him to remember. There was no evidence sinst the respectability of this girl. ‘This knew her Listory: he knew she was not a tutute. Cleaver knew it. He determined he the first man to have connection with ner, be did, snd now Jet him suffer tor it. Blood ot blood. Her blood cries to heaven for yen- geance The law of the tand, commends pri- vate vengeance, but it condemns public yeu- geance In conclusion, Mr. ©. charg-d the jury as conservators of the public peace to vindicate the majesty ofthe law. The cot of the humble man, like the castle of the nobleman, received alike the protection of the law. Ileave the casein your hands again, asking you in the spirit of law and justice by your verdict, as- sign to this prisoner that punishment which the law of the Isnd denounces as the great ctime which he bas committed agai God and bis country. Mr. Fendail. for the defense, followed Mr. Carrington.
